RECOMMENDATIONS:
ADOPT Resolution approving the thirteenth extension of the Subdivision Agreement for subdivision SD03-08744, for a project being developed by Discovery Builders, Inc., as recommended by the Public Works Director, Martinez area. (District V)
FISCAL IMPACT:
No fiscal impact.
BACKGROUND:
The terminal date of the Subdivision Agreement needs to be extended. The developer has not completed the required improvements and has requested more time. (Approximately 0% of the work has been completed to date.) By granting an extension, the County will give the developer more time to complete improvements and keeps the bond current.
CONSEQUENCE OF NEGATIVE ACTION:
The terminal date of the Subdivision Agreement will not be extended and the developer will be in default of the agreement, requiring the County to take legal action against the developer and surety to get the improvements installed, or revert the development to acreage.

IN THE MATTER OF: Approving the thirteenth extension of the Subdivision Agreement for subdivision SD03-08744, for a project being developed by Discovery Builders, Inc., as recommended by the Public Works Director, Martinez area. (District V)
WHEREAS, the Public Works Director having recommended that he be authorized to execute the thirteenth agreement extension which extends the subdivision improvement agreement between Discovery Builders, Inc. and the County for construction of certain improvements in subdivision SD03-08744, Martinez area, through August 14, 2026.
APPROXIMATE PERCENTAGE OF WORK COMPLETE: 0%
ANTICIPATED DATE OF COMPLETION: December 2028
BOND NO.: LICX1194585 Date: July 9, 2024
REASON FOR EXTENSION: Developer proposes to construct with the adjacent subdivision SD09-08809 Bayview Estates. Developer will start grading and installing improvements fall 2027, the paving of the roadway will take place in 2027. Vertical construction to start spring 2028.
NOW, THEREFORE, BE IT RESOLVED that the recommendation of the Public Works Director is APPROVED.
