Report Title: Park Dedication and Park Impact Fee Fund Authorization for Regatta Park

RECOMMENDATIONS:
AUTHORIZE the Auditor-Controller to release $419,000 from certain Park Dedication/Park Impact Fund Accounts to the Contra Costa County Public Works Department to help fund improvements at Regatta Park along Foghorn Way, Sailboat Drive, and Regatta Drive in Discovery Bay.
FISCAL IMPACT:
No Impact to the General Fund. 100% Park Dedication and Park Impact Fees deposited in the Discovery Bay area park accounts will be used to finance the improvements.
BACKGROUND:
Proposed Improvements
The Town of Discovery Bay and Contra Costa County are working on a project to expand the use of Regatta Park, including increased American with Disabilities Act (ADA) access. The proposed improvements augment on a project that was completed in 2023, including a new ADA play structure that was added to the park partially funded through the State of California’s Park and Water Bond (Prop 68) program. The proposed improvements continue the work funded through Prop 68, including required improvements associated with ADA access, by restriping the parking lot to accommodate users of the new play structure and conducting parking lot repairs. Additional improvements include replacing a second play structure on the site and poured-in-place surfacing, installing a shade structure over the ADA playground, and installing a new water fountain. The new structure will be similar in size but includes expanded and improved features for children between the ages of 5-12 years old. The overall project will upgrade, modernize, and improve the quality of recreation amenities offered to the community.
Park Fund Background
The County imposes fees on residential development to fund park and recreational facilities under both the County’s Park Dedication Ordinance and the County’s Park Impact Fee Ordinance. Funds from these fees are deposited into accounts associated with the census tracts where the residential development occurs to ensure the funds are directed to park and recreational facilities which serve the residents of the development. The following table outlines the Discovery Bay Park Dedication and Park Impact fee accounts that will be used for the project. Use of the park fees identified are reasonably related to proposed improvements at Regatta Park and are consistent with government code section 66001(a)(3)-(4), because the proposed park improvement will serve the Discovery Bay community, including the areas from which the proposed expenditures were collected.

Applicable General Plan Goals and Policies
The proposed project implements the following General Plan Park and Recreation Goal:
• Goal PFS-8: An easily accessible, integrated system of high-quality parks and trains to meet the needs of all residents
The proposed project implements the following General Plan Park and Recreation Policies:
• Support development of a variety of local amenities that meet a diverse range of recreational needs, such as ballfields, all-abilities playgrounds, tot lots, spraygrounds, adult fitness courses, gymnasiums, swimming pools, sport courts, passive parks, pocket parks, urban gardens, and trails. (PFS-P8.1)
• Provide a local park within a safe 10-minute walk for all residents in urban communities or within a 5-minute drive for residents in suburban communities, as indicated in Figures PFS-9 and PFS-10. (PFS-P8.2)
• Design recreational facilities to complement the natural features of the area, including topography and vegetation, whenever appropriate. (PFS-8.7)
California Environmental Quality Act (CEQA)
The Board of Supervisors determined the ADA play structure project is California Environmental Quality Act (CEQA) Categorical Exemption pursuant to Article 19, Section 15303(e) of the CEQA guidelines on December 14, 2021.
There is a separate Board Agenda item on the June 10, 2025 Board Agenda to authorize the remainder of the project and find it exempt from the California Environmental Quality Act (CEQA) pursuant to Article 19, Sections 15302, 15303, and 15304 of the CEQA guidelines.
CONSEQUENCE OF NEGATIVE ACTION:
If the funds are not authorized, there will not be sufficient funding to complete the project.
