Report Title:                     Approve the Parcel Map and Subdivision Agreement for urban lot split minor subdivision MS23-00019, for a project being developed by Sarge and Deborah Kennedy, Danville area.

RECOMMENDATIONS:

ADOPT Resolution approving the Parcel Map and Subdivision Agreement for urban lot split minor subdivision MS23-00019 (cross reference UL23-00001), for a project being developed by Sarge and Deborah Kennedy, as recommended by the Public Works Director, Danville area. (District II)

 

 

FISCAL IMPACT:

No fiscal impact.

 

 

BACKGROUND:

The Public Works Department has reviewed the urban lot split minor subdivision MS23-00019 (submitted and filed under UL23-00001) and has determined that all requirements for Parcel Map approval have been satisfied.

 

 

CONSEQUENCE OF NEGATIVE ACTION:

The Parcel Map and Subdivision Agreement will not be approved and recorded.

IN THE MATTER OF: Approving the Parcel Map and Subdivision Agreement for urban lot split minor subdivision MS23-00019 (cross reference UL23-00001), for a project being developed by Sarge and Deborah Kennedy, as recommended by the Public Works Director, Danville area. (District II)

 

 

WHEREAS, the following documents were present for board approval this date:

 

I.                     Map

                     The Parcel Map of urban lot split minor subdivision MS23-00019, property located in the Danville area, Supervisorial District II, said map having been certified by the proper officials.

 

II.                     Subdivision Agreement

                     A subdivision agreement with Sarge and Deborah Kennedy, principal, whereby said principal agrees to complete all improvements as required in said subdivision agreement within 2 years from the date of said agreement.  Accompanying said subdivision agreement is security guaranteeing completion of said improvements as follows:

 

A.                     Cash Bond

Performance amount:  $11,000

Labor & Materials Amount:  $5,500

Auditor’s Deposit Permit No. 881804                     Date:  12-7-2023

Submitted by:  Sarge and Deborah Kennedy

 

III.                     Tax Letter

                     Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 2024-2025 tax lien has been paid in full.

 

NOW, THEREFORE, BE IT RESOLVED

end

 

1.                     That said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County’s general and specific plans.

2.                     That said Parcel Map is APPROVED and this Board does hereby accept subject to installation and acceptance of improvements on behalf of the public any of the streets, paths, or easements shown thereon as dedicated to public use.

3.                     That said subdivision agreement is also APPROVED.
