RECOMMENDATIONS:
APPROVE and AUTHORIZE the Purchasing Agent, or designee, to execute on behalf of the Health Services Director, a purchase order with Transport Products Unlimited, Inc. in an amount not to exceed $13,000 and rental contract for the rental of a refrigerated container for Contra Costa Regional Medical Center (CCRMC) facilities construction project from February 1, 2026 through February 28, 2027.
FISCAL IMPACT:
Approval of this action will result in expenditures of up to $13,000 and will be funded by Hospital Enterprise Fund I revenues.
BACKGROUND:
Transport Products Unlimited, Inc. provides CCRMC with a refrigerated 20-foot storage container. This container is essential for storing essential food and beverage supplies for the Nutritional Services Department’s refrigerator and freezer areas and to ensure compliance with regulatory requirements during planned construction.
Uninterrupted refrigerated storage is essential to maintaining food safety standards for patients at CCRMC and to ensure compliance with regulatory requirements for the Nutritional Services Department during the active construction period.
In February 2026, CCRMC staff began working with Transport Products Unlimited, Inc. to assess facility needs, obtain a quote, and complete the required documentation to establish a rental contract. This process extended over several months. The container was delivered and placed into service prior to contract execution because construction timelines required immediate refrigerated storage for the Nutritional Services Department. During this period, CCRMC also required calibration of temperature-monitoring equipment which added to the delay. Despite good-faith efforts to finalize the agreement before use, invoices were generated prior to contract approval. CCRMC will aim to initiate requests prior to delivery of services for future projects.
The terms and conditions of the lease contract with Transport Products Unlimited, Inc. (TPU) provides that, from the time the County takes delivery until the return of the containers, the County is responsible for all risks, including loss and damage associated with the use and transport of the containers. TPU shall not be held liable for any loss or damage to the property of the County or others, nor for any personal injuries. Additionally, the County agrees to indemnify TPU for any losses related to the containers and for all damages resulting from premature redeliveries.
CONSEQUENCE OF NEGATIVE ACTION:
If this action is not approved, CCRMC may face significant challenges, including the risk of compromised supply integrity, non-compliance with regulatory requirements, and potential disruptions to patient care due to inadequate storage conditions.
