RECOMMENDATIONS:

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute an amendment to the Joint Exercise of Powers Agreement pertaining to the Southern Contra Costa Fees for Traffic Mitigation (SCC JEPA) between Contra Costa County (County), the City of San Ramon (City), and the Town of Danville (Town), San Ramon and Danville Areas. (District II)

 

FISCAL IMPACT:

100% Local Road Funds

 

BACKGROUND:

In 1996, the County, City, and Town (collectively “parties”) entered into a Joint Exercise of Powers Agreement pertaining to Southern Contra Costa Fees for Traffic Mitigation. The SCC JEPA provides a mechanism to collectively mitigate the impacts of additional traffic generated by development in the southern part of Contra Costa County, generally from Alamo south to the county line. The SCC JEPA was structured to address the findings of the August 1996 Development Program Report (DPR) for the Southern Contra Costa Fee Areas.

 

The SCC JEPA includes two fees that all three jurisdictions participate in the SCC Regional Fee and the SCC Sub-Regional Fee. The Regional Fee is dedicated to area freeway improvement projects, benefiting the entire SCC area. The SCC JEPA included an initial list of three projects to be funded in part by the SCC Regional Fee improvements to the Interstate 680 (I-680) ramps at Alcosta Boulevard, the auxiliary lane along I-680 from Diablo Road to Bollinger Canyon Road, and the I-680 on- and off- ramps at Stone Valley Road.

 

The DPR anticipated that changes in circumstances would require periodic review and updates to the SCC fees to address changing impacts and mitigations, and the SCC JEPA provides that the parties shall review and may update the list of projects annually.

 

The parties have met and determined that it is appropriate to amend the list of SCC Regional projects to include freeway improvements to I-680 planned by the Contra Costa Transportation Authority (CCTA). The improvements identified by CCTA are collectively described as “Innovate 680.” The regional impact of those improvements and their relation to planning documents for all three entities are addressed in a report prepared by Fehr & Peers, dated May 19, 2026, which is incorporated herein by this reference.

 

With the addition of Innovate 680 to the list of SCC Regional Fee projects, the parties will allocate existing fund balances, if any, as allowed in this amendment and will cease future collection of the SCC Regional Fee.

 

CONSEQUENCE OF NEGATIVE ACTION:

If the Public Works Director is not authorized to execute the amendment to the Joint Exercise Powers Agreement, the parties will be unable to allocate existing fund balances to freeway improvements to I-680, and design and construction of these improvements will be delayed and may not be constructed.
