Report Title:                     Allocation of Livable Communities Trust Funds (District II and District III portions)

Recommendation of the County Administrator Recommendation of Board Committee

 

RECOMMENDATIONS:

1.                     APPROVE an allocation of $50,000 from the Livable Communities Trust (District II portion) to the Siesta Valley Foundation for the ADA and Accessibility Improvements Project, as recommended by Supervisor Andersen.

 

2.                     AUTHORIZE the Conservation and Development Director, or designee, to execute a contract with Siesta Valley Foundation in an amount not to exceed $50,000 for the ADA and Accessibility Improvements Project, subject to approval by the County Administrator and approved as to form by County Counsel. 

 

3.                     APPROVE an allocation of $250,000 from the Livable Communities Trust (District III portion) to The Friends of the Oakley Library for the Oakley Library and Community Center Project, as recommended by Supervisor Burgis.

 

4.                     AUTHORIZE the Conservation and Development Director, or designee, to execute a contract with The Friends of Oakley Library in an amount not to exceed $250,000 for Oakley Library and Community Center Project subject to approval by the County Administrator and approved as to form by County Counsel. 

 

FISCAL IMPACT:

100% Livable Communities Trust. This action allocates $50,000 from the District II portion of Livable Communities Trust Fund and $250,000 from the District III portion of the Fund monies. The current available balance in the District II portion of the Fund to allocate is $1,407,040.95 (prior to the allocation). The current available balance in the District III portion of the Fund to allocate $1,549,013.95 (prior to the allocation).

 

BACKGROUND:

Livable Communities Trust Fund

The Livable Communities Trust Fund (LCT Fund) is a Special Revenue Mitigation Fund that was established by the Board of Supervisors on November 15, 2005, following the approval of the Camino Tassajara Combined General Plan Amendment Project, also known as the Alamo Creek and Intervening Property residential projects, and was required as a condition of approval. The Fund was established to implement the County’s Smart Growth Action Plan. The residential developers pay an $8,000 per unit fee (excluding the affordable housing portions of the projects) into the Trust. The Department of Conservation and Development administers the Fund.

 

On December 3, 2013, the Board of Supervisors determined that revenue from the Fund should be spent equally among supervisorial districts. At complete build-out, deposits to the Fund will total $8,448,000. As of May 15, 2026, the account has collected $8,376,000 in revenue fees, and $1,869,069.77 accrued interest with $3,549,571.13 remaining in uncommitted funds. The approved expenditures to date are attached.

 

Siesta Valley Foundation ADA and Accessibility Improvement Project

The Siesta Valley Foundation is requesting, and Supervisor Anderson recommends $50,000 of LCT Funds for the American Disabilities Act (ADA) and Accessibility Improvement Project at the former Cal Shakes/Burns Amphitheatre located at 100 Gateway Boulevard in the City of Orinda. The project includes ADA accessibility and site improvements to enable safe public use of the former Cal Shakes/Bruns Amphitheatre venue. Work will upgrade accessible paths of travel from the meadow to the amphitheater, add ADA-compliant seating and parking, and improve restroom accessibility. Additional enhancements include pathway lighting, entry and queue management improvements, drainage and erosion control, and general site repairs. These improvements ensure compliance with accessibility standards while enhancing overall safety and visitor experience. The total project cost is projected to be $122,000, with $78,000 for ADA improvements and $44,000 for site and safety improvements. The project supports Smart Growth Action Plan number four: To promote economic revitalization in urban infill communities.

Oakley Library and Community Center Project

The Friends of the Oakley Library is requesting, and Supervisor Burgis recommends $250,000 of LCT Funds for the Oakley Library and Community Center Project located at 3235 Main Street in the City of Oakley. The proposed Oakley Library and Community Center project is a new single-story, approximately 13,370 square-foot civic center site located in downtown Oakley. It is designed to serve as a flexible, multi-functional community hub. The project will replace the existing Oakley library that shares space with the library at Freedom High School. The Library Project expects to break ground on construction in October with construction expected to be complete by the end of 2027. The overall budget for the Library Project is $13 million. That budget includes approximately $1 million that The Friends of the Oakley Library has raised, which includes this allocation of $250,000 of LCT Funds recommended by Supervisor Burgis. To date, the project has the initial design-build agreement which covers the concept level work, as well as the design-build agreement through building permits. As proposed, the $250,000 of LCT Funds will pay for the soft-cost work related to the design-build agreement. The Library Project supports Smart Growth Action Plan number three: Promote innovative land use planning and design principles that encourage mixed used and infill development.
