RECOMMENDATIONS:
APPROVE and AUTHORIZE the Purchasing Agent, or designee, to execute on behalf of the Health Services Director, a purchase order with Canva US, Inc. in an amount not to exceed $59,000 and an agreement for Canva Enterprise subscriptions and onboarding services, effective upon the date of last signature and for twelve months thereafter.
FISCAL IMPACT:
Approval of this action will result in expenditures of up to $59,000 and will be funded by Hospital Enterprise Fund I revenues.
BACKGROUND:
Contra Costa Health's Community Education and Information program utilizes Canva to create digital and print communications materials that support public information, community outreach, employee communications, health education and emergency communications activities.
Canva Enterprise provides a centralized design platform that enables staff to create, manage, and share branded communications materials while maintaining accessibility, consistency, and compliance with organizational standards. The agreement includes 150 user licenses and enhanced onboarding services to support implementation, account configuration, training, and brand management.
Approval of this agreement will allow Contra Costa Health to use Canva Enterprise as a standardized communications platform and provide staff with access to design, collaboration, and content management tools necessary to support departmental communications activities. The Department procured three competitive bids for these services to ensure fair pricing and compliance with County procurement requirements.
Canva is not liable for infringement claims arising from: (i) misuse of Licensed Content (ii) unauthorized combinations or modifications, (iii) disregarding Canva’s stop-use instructions, (iv) infringing Input or Output, (v) intentional infringement with AI, or (vi) Service misuse or agreement violations. Canva’s liability under AI Output Indemnity is limited to the greater of (i) three times the Subscription Fees paid by County in the 12 months before the indemnity notice or (ii) USD $3,000,000.
CONSEQUENCE OF NEGATIVE ACTION:
Failure to approve this action may limit the department's ability to efficiently develop and distribute communications materials, support public outreach efforts, and maintain consistent branding and accessibility standards across communications products.
