I. PROJECT SUMMARY
The applicant requests approval of a Land Use Permit for the continuing operation of an existing T-Mobile wireless telecommunications facility that was previously re-established under Land Use Permit CDLP15-02049. No modifications of the wireless facility are proposed.
II. RECOMMENDATION
Department of Conservation and Development, Community Development Division (CDD) staff recommends that the Zoning Administrator:
A. OPEN the public hearing on the Land Use Permit for the continuing operation of an existing T-Mobile wireless telecommunications facility, RECEIVE testimony, and CONTINUE the Land Use Permit as an open item for a Zoning Administrator decision at a noticed public hearing, to be held on a date to be determined.
III. BACKGROUND
This Land Use Permit application was considered by the Zoning Administrator during a noticed public hearing held on March 2, 2026. During the meeting, the Zoning Administrator opened the public hearing and heard testimony from the applicant as well as the property owner and one of the adjacent neighbors. The property owner and neighbor discussed having conflicting ownership of the lease area, which raised concerns regarding authorization of use on the property. After discussion, the Zoning Administrator determined that additional time was required to resolve the ownership and authorization matter. The Zoning Administrator initially continued the item to the April 6, 2026 meeting; however, during the meeting, it was determined that additional time was required. Therefore, the Zoning Administrator continued the item as an open public hearing for additional consideration at the May 18, 2026, meeting.
IV. CONCLUSION
There has yet to be a resolution pertaining to the authorization from the appropriate property owner to the applicant on file. No additional information or confirmation have been submitted to this date. Therefore, CDD staff recommends that the Land Use Permit be continued indefinitely to allow additional time for the applicant to provide documentation showing a resolution regarding proper authorization from the appropriate property owners.
