Report Title: Terminations #78-041-1 and #72-201-1 with Food Bank of Contra Costa and Solano
Recommendation: Recommendation of the County Administrator

RECOMMENDATIONS:
APPROVE and AUTHORIZE the Health Services Director, or designee, to terminate the following contracts: (1) Memorandum of Understanding (MOU) #78-041 with the Food Bank of Contra Costa and Solano, a non-profit corporation; and (2) MOU #72-201 with the Food Bank of Contra Costa and Solano, a non-profit corporation, for coordination and delivery services of fresh produce to Women, Infant and Children (WIC) program participants and other low-income families in Concord and Pittsburg, effective at the close of business on October 6, 2026.
FISCAL IMPACT:
Non-financial. There is no fiscal impact.
BACKGROUND:
The Food Bank of Contra Costa and Solano will offer free fresh produce to low-income families at the WIC sites in Concord and Pittsburg through its Community Produce Program. This partnership will improve low-income families' access to free fresh produce. The Food Bank’s Community Produce Program will distribute produce directly to WIC program participants and other low-income families in the community by utilizing a customized food bank vehicle. Twice a month the produce truck will be parked in the parking lot at the Concord and Pittsburg WIC sites and offer fresh free fruits and vegetables to WIC program participants and other low-income families in the community. The purpose of this partnership is to encourage healthy lifestyle and healthy food choices in the community by providing access to fresh produce to low-income families. Contractor has provided these services while fostering a deep understanding of Public Health’s mission, values, and long-term objectives since 2023.
On September 12, 2023, the Board of Supervisors approved MOU #78-041 with the Food Bank of Contra Costa and Solano, to provide coordination and delivery services of fresh produce to County WIC program participants and other low-income families in Concord, effective upon Board approval until terminated with a 30-day notice by either party. This MOU includes a provision requiring the County to indemnify the Food Bank of Contra Costa and Solano for any claims arising out of the performance of this MOU.
On October 24, 2023, the Board of Supervisors approved MOU #72-201 with the Food Bank of Contra Costa and Solano, to provide coordination and delivery services of fresh produce to County WIC program participants and other low-income families in Pittsburg, effective upon Board approval until terminated with a 30-day notice by either party. This MOU includes a provision requiring the County to indemnify the Food Bank of Contra Costa and Solano for any claims arising out of the performance of this MOU.
Approval to terminate MOU’s #78-041 and #72-201 will allow the County and Food Bank of Contra Costa and Solano to establish a revised MOU with updated scope and terms to continue coordination and delivery services of fresh produce for WIC program participants in Concord and Pittsburg.
CONSEQUENCE OF NEGATIVE ACTION:
If the terminations are not approved, a new MOU will not be established, and the current scope and terms under the current MOUs will remain outdated.
