Report Title: SB 1057 (Menjivar) Juvenile Justice Coordinating Council

RECOMMENDATIONS:
ADOPT a position of “Oppose” on SB 1057 (Menjivar) Juvenile Justice Coordinating Council, a bill that proposes to make considerable changes to the local planning body and associated processes for the deployment of Juvenile Justice Crime Prevention Act (JJCPA) funds, as recommended by the Legislation Committee of the Board.
FISCAL IMPACT:
According to the Chief Probation Officers of California: “SB 1057…would repurpose and reprioritize new processes thereby redirecting the expenditure of critical juvenile justice investments which are expended in accordance with research-based standards and producing highly effective results.”
BACKGROUND:
At their April 16, 2024 meeting, the Legislation Committee (Chair Burgis/Vice Chair Carlson) considered and supported a recommendation from the County’s Chief Probation Officer to oppose SB 1057 (Menjivar). SB 1057 is also opposed by CSAC, the Urban Counties of California, and the Rural County Representatives of California. (See Attachment C.)
SB 1057, as recently amended, proposes considerable changes to local Juvenile Justice Coordinating Councils (JJCC), as well as to the process for the JJCCs’ deployment of Juvenile Justice Crime Prevention Act (JJCPA) funds. These funds were realigned to counties in 2011 and serve as the bedrock of counties’ juvenile justice systems.
SB 1057 recasts the composition of the JJCC by (1) requiring that the body be comprised of at least half community representatives and the remainder allocated to representatives from government agencies, as specified in the bill (2) removing the chief probation officer as the chair of the JJCC and instead specifying that the JJCC with its newly formulated composition shall elect two co-chairs, at least one of whom must be a community representative. The bill would require that if bylaws establish term limits, all individuals of the council be subject to term limits. In addition, this measure confers authority to the Board of State and Community Corrections (BSCC) or other state entity with oversight over administration of these funds to determine remedial action or to withhold JJCPA funding if a county fails to establish a JJCC. Finally, it establishes a new request for proposal (RFP) process for JJCPA funds under which a local agency other than a law enforcement related agency - with a stated preference for behavioral health-related local agencies - must administer the RFP.
