RECOMMENDATIONS:

APPROVE and AUTHORIZE the District 3 Supervisor to execute, on behalf of the County, an agreement among the County, the Bethel Island Municipal Improvement District (BIMID), and Mt Diablo Resource Recovery, to jointly host a Bethel Island Community Cleanup Day on November 8, 2025, within BIMID-owned property identified as Assessor’s Parcel No. 029-040-011, Bethel Island area, as recommended by the Bethel Island Municipal Advisory Council and the District 3 Supervisor.

 

DETERMINE that this activity is exempt from the California Environmental Quality Act pursuant to CEQA Guidelines section 15311, and, alternatively, section 15061(b)(3), because it can be seen with certainty that there is no possibility that the temporary placement debris boxes and use of the property may have a significant effect on the environment.

 

 

 

FISCAL IMPACT:

BACKGROUND:

In 2024, the County, Mt Diablo Resource Recovery (MDRR), and the Bethel Island Municipal Improvement District (BIMID) entered into an agreement to host a community cleanup day on Bethel Island.  That earlier agreement had been open ended to allow future events without having to prepare a new agreement. After a successful event in 2024, BIMID terminated the agreement to renegotiate certain terms. 

 

The new agreement between the County, MDRR, and BIMID will be effective November 7, 2025, and it will terminate at 11:59 p.m., on November 9, 2025.  This term allows for event setup, a community cleanup event on November 8, 2025, and event cleanup.  Under the agreement, the District 3 Supervisor’s Office will be responsible for coordinating event setup, registration, and cleanup; MDRR will provide the debris boxes at no cost; and BIMID will license the use of its property for the event.

 

The County will indemnify BIMID from liabilities that arise from the event being held on BIMID’s property.  MDRR will indemnify the County and BIMID from liabilities that arise from placing and removing debris boxes, and MDRR will release the County and BIMID from any claims related to loss or damage of its vehicles or debris boxes. 

 

Although the agreement has a term of three days to cover only the 2025 event, the same agreement form can be used for community cleanup events in future years. 

 

 

 

CONSEQUENCE OF NEGATIVE ACTION:

The November 8, 2025 Bethel Island Community Cleanup event would not be held on BIMID property, and an alternative location would need to be identified.
