Report Title:                     Participation Agreement Amendment #74-754-1 with California Mental Health Services Authority

Recommendation of the County Administrator Recommendation of Board Committee

 

RECOMMENDATIONS:

APPROVE and AUTHORIZE the Health Services Director, or designee, to execute on behalf of the County Participation Agreement Amendment #74-754-1 with California Mental Health Services Authority (CalMHSA), a government agency, effective January 1, 2025, to amend Participation Agreement #74-754, to decrease the payment limit by $16,200, from $81,000 to a new payment limit of $64,800, and to decrease the scope of reportable measures regarding the Alcohol and Other Drug Services (AODS) Division’s participation in the Healthcare Effectiveness Data and Information Set (HEDIS) Performance Measurement Program with no change in the term of January 1, 2025 through December 31, 2029.

 

FISCAL IMPACT:

Approval of this Agreement Amendment will result in a decrease of expenditures of $16,200 funded by Alcohol and Other Drug Services (AODS) Administrative funds.  (No rate increase)

 

BACKGROUND:

California Advancing and Innovating Medi-Cal (CalAIM) Act requires each state Medicaid agency to produce a written quality strategy to access and improve the quality of health care and services. CalMHSA is a National Committee for Quality Assurance (NCQA) Certified vendor for all NCQA performance measures. This Participation Agreement with CalMHSA will support Behavioral Health’s AODS division in meeting the mandated State requirements. This Agreement included support services for Behavioral Health’s Mental Health division however the Mental Health division will not be necessitating services provided by this Agreement.  This Agreement Amendment removes all mental health support services to ensure consistency with the scope of services and reduce the total payment amount by $16,200.

 

This Agreement was approved by Health Services Personnel to ensure there is no conflict with labor relations. This Contractor was approved by the Public Works Department’s Purchasing Division on November 5, 2025.

 

On December 16, 2025, the Board of Supervisors approved Participation Agreement #74-754 with California Mental Health Services Authority, in an amount not to exceed $8100, to support AODS in meeting the Behavioral Health Accountability Set (BHAS) reporting requirements for the HEDIS Performance Measurement Program for the period January 1, 2025 through December 31, 2029. This Agreement included a mutual indemnification provision that requires the parties to defend, indemnify, save and hold harmless each other for claims arising under the Agreement. After review of the Agreement, it was determined mental health support services needed to be removed and backdating the effective date to January 1, 2025.

 

Approval of Agreement Amendment #74-754-1 will allow the parties to amend the contract to accurately reflect the reporting measures that are required for the County’s Drug Medi-Cal Organized Delivery System Plan through December 31, 2029.

 

CONSEQUENCE OF NEGATIVE ACTION:

If this Agreement Amendment is not approved, the Agreement will continue to list mental health support services which are inconsistent with the intent of the Agreement.
