Report Title: Grant Application in Support of the Behavioral Health Continuum Infrastructure Project Bond BHCIP Round 1

RECOMMENDATIONS:
APPROVE and AUTHORIZE the Health Services Director, or her designee, to apply for grant funding, made available by the State Department of Health Care Services through the Behavioral Health Continuum Infrastructure Project (BHCIP), to fund the purchase, development and/or renovation of facilities to serve Medi-Cal eligible clients with serious behavioral health conditions.
APPROVE resolutions authorizing the Health Director or her designee to apply for up to $100 million in grant funds under the BHCIP Round 1 Launch Ready Program.
FISCAL IMPACT:
If awarded grant funds, County will receive funds from the State of California Department of Health Care Services for BHCIP through their administrator, Advocates for Human Potential, for the purchase or remodel of public behavioral health facilities. County will be responsible for 10% match of the entire project. County-owned real property may be used as match. Additionally, if awarded, County will agree to maintain the use of the property for a period of 30 years for BHCIP funded project, which will be secured through a declaration of restrictions recorded against the portion of the property to be used by the project.
BACKGROUND:
In March of 2024, California voters approved Proposition 1, a two-bill package amending the Mental Health Services Act (Senate Bill 326) and the Behavioral Health Bond Infrastructure Act of 2024 (Assembly Bill 531) to develop and expand an array of community behavioral health treatment and residential facilities through a competitive grant program administered by the Department of Health Care Services (DHCS) with up to $4.4 billion dollars available statewide. Under the previous authorization of this program, Contra Costa County was awarded $18.6 million dollars and is currently finalizing design to open the first in-County Mental Health Rehabilitation Center.
In order to develop priorities for the facilities to be developed Contra Costa Behavioral Health has conducted a qualitative and quantitative needs assessment with community stakeholders. This needs assessment identified an additional need for crisis and longer-term residential treatment programs, both secure and voluntary, for adults with serious mental illness, many of whom have a co-occurring substance use disorder and/or are involved with the criminal justice system. Additionally, substance use treatment, including medical detoxification and sobering centers were identified as appropriate areas of expansion for the substance use treatment continuum of care.
Applications for both purchase of real estate and development and/or remodel costs require site control of the property, including a deed or executed purchase agreement, as well as preliminary plans (e.g., schematic design); reasonable project budget and timeline with identified development team (i.e., contractor, architect, engineer, etc.); proposed facility types with plan for licensure and certification; and commitment from CCH-BH to fund Medi-Cal services at the location.
Contra Costa Health - Behavioral Health (CCH-BH) currently intends to submit applications to fund projects at five (5) sites to include up to ten (10) different facility types to expand or address network shortfalls of available behavioral health services available to County residents living with severe and persistent behavioral health conditions. CCH-BH has partnered with County Public Works to facilitate obtaining the necessary architecture, real estate and construction management services required to submit applications under this program. Applications for Bond BHCIP Round 1 are due December 13, 2024. Board authorization by way of the resolutions associated with this staff report are requirements for grant submission.
The County is currently considering four (4) projects at County owned sites under this program: the development of two (2) social rehabilitation facilities at 2523 El Portal in San Pablo; the development of one social rehabilitation facility at 2025 Sherman Drive in Pleasant Hill; the development of a sobering center, medical detoxification unit, and crisis triage center on vacant land at 2311 Loveridge Road in Pittsburg; and the development of a dual-diagnosis treatment program through the renovation of 4639 Pacheco Boulevard in Martinez. The anticipated total value of all grant applications is anticipated not to exceed $100,000,000.
The County is not obligated to accept funds from any award that is made. CCH-BH will return to the Board of Supervisors for approval of any projects that may be awarded, acceptance of the award, and any terms and conditions required by the award.
CONSEQUENCE OF NEGATIVE ACTION:
County would not be eligible to receive funds to invest in behavioral health care infrastructure or housing options for Medi-Cal eligible behavioral health clients.

A RESOLUTION OF THE BOARD OF DIRECTORS OF SUPERVIORS OF CONTRA COSTA COUNTY AUTHORIZING APPLICATION TO AND PARTICIPATION IN THE BEHAVIORAL HEALTH CONTINUUM INFRASTRUCTURE PROGRAM (“BHCIP”)
WHEREAS,
A. The California Department of Health Care Services, through its contractor Advocates for Human Potential, Inc., (“Department”) has issued a Request for Applications, dated July 15, 2024 (“RFA”), for the BHCIP Round 1 (2024) Launch Ready Program (“Program”). The Department has issued the RFA for Program grant funds pursuant to California Welfare and Institutions Code sections 5965-5967.01 (“Behavioral Health Infrastructure Bond Act of 2024”).
B. Contra Costa County, a political subdivision of the State of California (“Applicant”),desires to apply for Program grant funds and has submitted an application for Program grant funds (“Application”) to the Department for review and consideration.
C. The Department is authorized to administer BHCIP pursuant to the Behavioral Health Infrastructure Bond Act of 2024. Program funding allocations are subject to the terms and conditions of the RFA, the Application, Program Funding Agreement (“Program Funding Agreement”), and all other legal requirements of the Program.
NOW, THEREFORE, BE IT RESOLVED

1. Applicant is hereby authorized and directed to submit an Application to the Department in response to the RFA, and to apply for Program grant funds in a total amount not to exceed $100,000,000.
2. If the Application is approved, Applicant is hereby authorized and directed to enter into, execute, and deliver a Program Funding Agreement for the total award amount, and all other documents required or deemed necessary or appropriate to secure the Program grant funds from the Department and to participate in the Program, and all amendments thereto (collectively, the “Program Documents”).
3. Applicant acknowledges and agrees that it shall be subject to the terms and conditions specified in the Program Funding Agreement. Any and all activities, expenditures, information, and timelines represented in the Application are enforceable through the Program Funding Agreement. Funds are to be used for the allowable expenditures and activities identified in the Program Funding Agreement.
