RECOMMENDATIONS:
ADOPT Resolution accepting completion of landscape improvements and release of cash deposit for faithful performance for a Drainage Improvement Agreement (for landscaping) for Drainage Improvement Agreement DA11-00068 (cross-reference subdivision SD04-08856), for a project being developed by Shapell Homes, a Division of Shapell Industries, Inc., a Delaware Corp., as recommended by the Public Works Director, San Ramon (Dougherty Valley) area. (District II)
FISCAL IMPACT:
100% Developer Fees.
BACKGROUND:
The developer has completed the landscape improvements under the Drainage Improvement Agreement (Landscaping), and in accordance with the Title 9 of the County Ordinance Code.
CONSEQUENCE OF NEGATIVE ACTION:
The completion of improvements will not be accepted.

IN THE MATTER OF accepting completion of landscape improvements for a Drainage Improvement Agreement (for landscaping) for Drainage Improvement Agreement DA11-00068 (cross-reference subdivision SD04-08856), for a project being developed by Shapell Homes, a Division of Shapell Industries, Inc., a Delaware Corp., as recommended by the Public Works Director, San Ramon (Dougherty Valley) area. (District II)
WHEREAS, these improvements are approximately located near Dougherty Road and Bollinger Canyon Road.
WHEREAS, WHEREAS, The Public Works Director has notified this Board that the landscaping improvements for DA11-00068 (cross-reference Subdivision SD04-08856), have been completed as provided in the Drainage Improvement Agreement (for landscaping) with Shapell Homes, a Division of Shapell Industries, Inc., a Delaware Corp., heretofore approved by this Board;
NOW, THEREFORE, BE IT RESOLVED that the landscape improvements have been COMPLETED as of December 16, 2025 thereby establishing the six month terminal period for the filing of liens in case of action under said Drainage Improvement Agreement (for landscaping):

NAME OF SURETY: The Continental Insurance Company
BE IT FURTHER RESOLVED that upon acceptance by the Board of Supervisors, the San Ramon City Council shall accept the landscape improvements for maintenance with the Doughtery Valley Memorandum of Understanding.
BE IT FURTHER RESOLVED the payment (labor and materials) surety for $8,500.00, Bond No. 929541372 issued by the above surety be RETAINED for the six month lien guarantee period until June 16, 2026, at which time the Board AUTHORIZES the release of said surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that there is no warranty and maintenance period required, and the Public Works Director is AUTHORIZED to refund the $1000 cash security for performance (Auditor's Deposit Permit No. DP593201, dated December 12, 2011) plus interest in accordance with Government Code Section 53079, if appropriate, to Shapell Homes, a Division of Shapell Industries, Inc., a Delaware Corp. pursuant to the requirements of the Ordinance Code; and the Drainage Improvement Agreement (for landscaping) and surety bond, Bond No. 929541372, dated December 12, 2011 are EXONERATED.
