Recommendation: Recommendation of the County Administrator

RECOMMENDATIONS:
ADOPT a Resolution accepting as complete the contract work performed by Sletten Construction, a Montana Corporation, for the West County Accessible Room Conversion (WARC) Project located at 5555 Giant Highway, Richmond, CA.
AUTHORIZE the Auditor-Controller to release retention associated with the WARC Project.
FISCAL IMPACT:
The initial contract amount with Sletten Construction Company was $19,969,576. Mutually agreed upon change ordered total $3,685,413 bringing the final sum of the construction contract to $23,654,989. The acceptance of completion will not result in any new fiscal obligations for County, the retention funds have been withheld from payments in accordance with the contract documents. There are no ongoing operational costs or revenues are associated with this action.
BACKGROUND:
The West County Accessible Room Conversion (WARC) project was initiated to address longstanding accessibility and facility modernization needs at the West County Detention Facility (WCDF) in Richmond. The WCDF, constructed in the 1980s, has experienced significant wear to original fixtures and finishes over four decades of continuous operation, resulting in the need for comprehensive upgrades to meet current standards for accessibility and building integrity. In 2023, the County completed an updated Access Compliance Assessment Report for WCDF, which identified priority improvements necessary to achieve compliance with the 2010 ADA Standards for Accessible Design and applicable State codes. The WARC project was developed in direct response to these findings, with the goal of ensuring that the County’s detention system provides sufficient accessible housing and support facilities for individuals with disabilities, in accordance with federal and state requirements.
The project scope included the conversion of existing housing unit rooms to create additional ADA-accessible beds, as well as associated improvements to accessible paths of travel, showers, and bathrooms. In addition to accessibility upgrades, the project incorporated remediation of water and mold damage in Building 6, replacement of worn flooring and fixtures, and preventative maintenance measures to extend the useful life of the facility. The County utilized a progressive design-build procurement method to efficiently deliver the project, allowing for the integration of design and construction services and the ability to address unforeseen conditions and additional needs as they arose during implementation.
Throughout the course of the project, the Board of Supervisors approved a series of contract amendments to address expanded scope items, including additional fixture replacement, interior painting, fencing repairs, and paving of the facility’s interior fire road. These enhancements were incorporated to maximize operational efficiency and minimize future disruptions by completing all necessary work while housing units were temporarily unoccupied for construction. The project was managed in alignment with the County’s adopted Capital Facilities Master Plan and capital budgeting process, and was coordinated with other major detention facility improvements to ensure systemwide compliance and modernization.
The completion of the WARC project represents a significant milestone in the County’s ongoing efforts to provide safe, accessible, and code-compliant detention facilities. The project’s delivery supports the County’s broader objectives of maintaining public infrastructure, meeting legal obligations for accessibility, and responsibly stewarding public resources through coordinated capital planning and project management.
CONSEQUENCE OF NEGATIVE ACTION:
If the Board does not accept the Notice of Completion for the West County Accessible Room Conversion (WARC) project, the contract closeout process will be delayed, resulting in an extended period for the filing of stop payment notices and bond claims by contractors or suppliers. Failure to accept this Notice of Completion may also require continued administrative oversight and prevent the timely release of contract retention which may open the County to incurring additional expenses.
