RECOMMENDATIONS:
APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a Consulting Services Agreement (contract) amendment with Consor PMCM, Inc., effective September 30, 2024, to increase the payment limit by $50,000 to a new payment limit of $400,000 for on-call construction management services, and to extend the term from September 30, 2024, to September 30, 2025, Countywide. (County Project No.: Various) (All Districts )
FISCAL IMPACT:
Work performed under this amendment is funded by developer fees, local, state and federal funds for local road, flood control, and airport projects. (100% Various Funds)
BACKGROUND:
The Public Works Department is involved in various projects in the County that require construction management services for roads, flood control, and airport projects. Consor PMCM, Inc., is one of seven firms contracted to provide construction services on an “on-call” basis. The consultant may augment Public Works staff on an as-needed basis. They may be used as an extension of Public Works staff during busy times when extra help is needed or when in-house expertise is not available.
On September 21, 2021, the Board of Supervisors approved an initial contract with Consor PMCM Inc. (formally CPM Associates, Inc.) in the amount of $350,000 for construction management services for the Public Works Department. The term of the agreement expires on September 30, 2024.
Amendment #1, which was approved by the Board of Supervisors on September 12, 2023, changed the party to the contract, dated September 21,2021, from CPM Associate, Inc., to Consor PMCM, Inc, which was necessary for the continuation of on-call construction management services after CPM Associates, Inc., filed a name change with the California Secretary of State.
Amendment #2 modified the professional liability of insurance requirements.
This amendment will increase the payment limit to $400,000, and extend the contract term from September 30, 2024, to September 30, 2025, which is necessary for the continuation of on-call construction management services through the completion of the Taylor Boulevard at Greenhills Drive Sinkhole Project, which Consor PMCM, Inc., is currently providing construction management services under Task Order 4. Consor PMCM, Inc., was selected for construction management services of these projects through a qualification-based selection in accordance with Caltrans Local Assistance Procedures Manual (LAPM). The projects are anticipated to be completed within the next year.
Government Code Section 31000 and 4525 authorizes the County to contract for services, including the type of construction management services that Consor PMCM, Inc., provides.
CONSEQUENCE OF NEGATIVE ACTION:
Without approval from the Board of Supervisors, the Taylor Boulevard at Greenhills Drive Sinkhole Project will experience delays and added costs as the County solicits for new professional services.
