RECOMMENDATIONS:

APPROVE and AUTHORIZE the Purchasing Agent, or designee, to execute on behalf of the Health Services Director, a purchase order with San Jose Mothers’ Milk Bank, a non-profit corporation, in an amount not to exceed $25,000, and Memorandum of Understanding including limitation of liability, to provide donor milk for infant patients at Contra Costa Regional Medical Center (CCRMC) and Contra Costa Health Centers for the period of May 1, 2024 through April 30, 2025.

 

FISCAL IMPACT:

Approval of this action will result in budgeted expenditures of up to $25,000 and will be funded by Hospital Enterprise Fund I revenues.

 

BACKGROUND:

San Jose Mothers’ Milk Bank will collect, screen, process and pasteurize donor human milk in accordance with standards approved by the Human Milk Banking Association of North America (HMBANA) and in compliance with applicable state and federal law and deliver the processed human milk to CCRMC. Donor human milk for qualifying infants provides optimum nutrition and health benefits and is vitally important for sick and preterm infants.

 

On August 16, 2022, the Board of Supervisors approved item C.48 to execute Memorandum of Understanding (MOU) #76-779 with San Jose Mothers’ Milk Bank, including limitation of liability, in an amount not to exceed $30,000, to provide donor milk services for the period of September 1, 2022 through August 31, 2025.

 

CCRMC and Contra Costa Health Centers were notified that San Jose Mother’s Milk Bank would be increasing the rates in contract #76-779 effective May 1, 2024. The vendor also notified CCRMC that delays to the rate increase would not be possible and it was determined that we would need to establish a new agreement to incorporate the new rates. The current agreement with San Jose Mothers’ Milk Bank (contract #76-779) will be terminated effective April 30, 2024 in order to increase the pricing of the donor milk. It has also been determined that the MOU should be processed via a purchase order rather than a contract in accordance with Administrative Bulletin 600.3.

 

The MOU provides that neither party will be liable to the other for any direct, incidental, special, or consequential damages or costs of procuring substitute goods or services, and in no event will either party’s liability exceed the amount paid by the county during the prior three (3) month period. Approval of this action will allow CCRMC and Health Centers continued access to donor milk for infants without interruption through April 30, 2025.

 

CONSEQUENCE OF NEGATIVE ACTION:

If this action is not approved, infant patients requiring processed human breast milk will not have access to this product.
