Report Title:                     Hearing to Adopt the Stormwater Utility Area Assessment for Fiscal Year 2026-2027, Countywide. Project No. 4500-6X7041

Recommendation of the County Administrator Recommendation of Board Committee

 

RECOMMENDATIONS:

1. OPEN the public hearing on the Engineer’s Report and the proposed Stormwater Utility Area (SUA) assessments to be imposed within SUAs 1 through 18, countywide; RECEIVE and CONSIDER oral and written testimony, including objections and protests; and CLOSE the hearing.

 

2. DETERMINE that no changes to the SUA assessments or the Engineer’s Report will be made in response to any objections or protests and that the majority protest provisions do not apply because the assessments do not exceed the maximum amounts originally established and the method of their calculation has not changed.

 

3. DETERMINE that rates for each of SUA No. 1 through 18 for Fiscal Year 2026-2027 are the maximum rates per Equivalent Runoff Unit for each area as shown in the Engineer’s Report.

 

4. ADOPT the attached Resolution imposing the SUA assessments for Fiscal Year 2026-2027 within SUA Nos. 1 through 18.

 

5. DIRECT the Chief Engineer or designee to provide a certified copy of the Resolution and the roll of confirmed SUA assessments to the County Auditor-Controller before August 10, 2026 for collection of the SUAs on the County tax roll.

 

 

FISCAL IMPACT:

The proposed assessments for SUAs 1 through 18 will provide approximately $15,999,662 in funding for cities and the County for the National Pollutant Discharge Elimination System (NPDES) program and drainage maintenance. (100% Stormwater Utility Area Assessment)

 

 

BACKGROUND:

On May 12, 2026, the Board of Supervisors (Board) acknowledged the receipt of resolutions, requesting the adoption of the SUA assessments for Fiscal Year 2026-2027, adopted Resolution No. 2026-172, and directed the Clerk of the Board to fix a public hearing for June 9, 2026, in the Board chambers to receive and consider oral and written testimony, including objections and protests, on the Engineer’s Report and the proposed SUA assessments, as required by the Contra Costa County Flood Control and Water Conservation Act (Act). The majority protest procedure does not apply because the proposed rates for each SUA do not exceed the approved maximum rate for each area and because there has been no change in the methodology for how the assessment is calculated.

 

The Act, under the provisions of Section 12.8(a), authorizes the Board of the Contra Costa County Flood Control and Water Conservation District to levy assessments within SUAs. The Board must adopt the Resolution confirming the SUA assessments for the County, and the incorporated cities of Antioch, Clayton, Concord, Danville, El Cerrito, Hercules, Lafayette, Martinez, Moraga, Orinda, Pinole, Pittsburg, Pleasant Hill, San Pablo, San Ramon, Walnut Creek, and Oakley to levy SUA assessments for Fiscal Year 2026-2027. Confirmation of this Board action constitutes the levy of the SUA assessments for Fiscal Year 2026-2027.

 

 

CONSEQUENCE OF NEGATIVE ACTION:

If the proposed assessments for Fiscal Year 2026-2027 are not implemented, the program would have to be funded by the general funds or other sources of the cities and County to ensure compliance with NPDES permit requirements.

IN THE MATTER OF LEVYING THE ANNUAL STORMWATER UTILITY ASSESSMENT FOR FISCAL YEAR 2026-2027, COUNTYWIDE.

 

The Board of Supervisors of Contra Costa County (Board), as the governing body of the Contra Costa County Flood Control and Water Conservation District (Flood Control District), FINDS that:

 

WHEREAS, the Contra Costa County Flood Control and Water Conservation Act, under the provisions of Section 12.8(b), authorizes the Board to levy annual assessments within Stormwater Utility Areas (SUAs);

 

WHEREAS, Contra Costa County and the incorporated cities of Antioch, Clayton, Concord, Danville, El Cerrito, Hercules, Lafayette, Martinez, Moraga, Orinda, Pinole, Pittsburg, Pleasant Hill, San Pablo, San Ramon, Walnut Creek, and Oakley have presented to the Board resolutions determining their respective SUA assessment rates and requesting the Flood Control District to levy assessments in their respective areas;

 

WHEREAS, an Engineer’s Report meeting the requirements of Section 12.8© of the Act has been filed with the Clerk of the Board.

 

WHEREAS, a public hearing on the Engineer’s Report and the proposed assessments was held on June 9, 2026, notice of which was given in the manner required by Section 12.8 (c)(2)

 

WHEREAS, the rates for each SUA are the maximum rates per Equivalent Runoff Unit for each area as follows: SUA No. 1, Antioch-$25.00; SUA No. 2, Clayton-$29.00; SUA No. 3, Concord-$35.00; SUA No. 4, Danville-$30.00; SUA No. 5, El Cerrito-$38.00; SUA No. 6, Hercules-$35.00; SUA No. 7, Lafayette-$35.00; SUA No. 8, Martinez-$30.00; SUA No. 9, Moraga-$35.00; SUA No. 10, Orinda-$35.00; SUA No. 11, Pinole-$35.00; SUA No. 12, Pittsburg-$30.00; SUA No. 13, Pleasant Hill-$30.00; SUA No. 14, San Pablo-$45.00; SUA No. 15, San Ramon-$35.00; SUA No. 16, Walnut Creek-$35.00; SUA No. 17, Unincorporated County-$30.00; and SUA No. 18, Oakley-$30.00;

 

WHEREAS, the assessment rate to be imposed within each SUA does not exceed the maximum rates originally established for each SUA, and the method for calculating each assessments has not changed, and; therefore, the majority protest procedure and provisions of the Act do not apply;

 

NOW, THEREFORE, BE IT RESOLVED, the Board CONFIRMS the SUA assessment for the County, and the incorporated cities of Antioch, Clayton, Concord, Danville, El Cerrito, Hercules, Lafayette, Martinez, Moraga, Orinda, Pinole, Pittsburg, Pleasant Hill, San Pablo, San Ramon, Walnut Creek, and Oakley for Fiscal Year 2026-2027 to be imposed within SUA Nos. 1 through 18 are the maximum assessment rates per equivalent Runoff Unit set forth above, in accordance with Section 12.8 of the Act.
