RECOMMENDATIONS:
APPROVE and AUTHORIZE the Health Services Director or designee to execute on behalf of the County a Data Privacy and Security Agreement with the California Department of Public Health (CDPH) to protect the privacy and security of the California Integrated Vital Records System data (Cal-IVRS Data) to permit the County to collect, create, access, use and disclose Cal-IVRS Data pursuant to statute for a period of five (5) years from the date of the last signature on the agreement.
FISCAL IMPACT:
This is a non-financial Agreement.
BACKGROUND:
CDPH, designated as the State Registrar pursuant to Division 102 of the California Health & Safety Code, is charged with duties of registering, maintaining, indexing and issuing certified copies of California’s birth, death and fetal death records. As part of these activities, CDPH operates multiple databased and information technology systems. The data in these systems is, collectively, the Cal-IVRS Data.
Division 102 of the Health & Safety Code designates the County Health Officer as the local register of births and deaths (Local Registrar). To assess, use and disclose Cal-IVRS Data for purposes including epidemiologic, analysis, surveillance and program evaluation, the Local Registrar must execute the five-year Cal-IVRS Data Privacy and Security Agreement.
The Cal-IVRS Data Privacy and Security Agreement requires the County to indemnify, hold harmless, and defend CDPH from and against any and all claims, losses, liabilities, damages, costs and other expense that arise from the negligent act, omissions, or willful misconduct of the Local Register, its officers, agents or workforce.
CONSEQUENCE OF NEGATIVE ACTION:
Without authority to execute the Cal-IVRS Data Privacy and Security Agreement, the County will be unable to access Cal-IVRS Data as necessary to fulfill the duties of the Local Registrar.
