RECOMMENDATIONS:

APPROVE and AUTHORIZE the Purchasing Agent, on behalf of the Chief Information Officer, to execute a purchase order with 11:11 Systems, Inc. (as successor in interest to SunGard AS) in an amount not to exceed $62,000 for systems and mainframe disaster recovery services, subject to SunGard’s Recovery Services Agreement, for the period of July 1, 2025, through June 30, 2026.

FISCAL IMPACT:

The cost of this product is included in the Department’s FY 25-26 budget. 100% User Departments.

BACKGROUND:

11:11 Systems Inc. (as successor in interest to SunGard AS) provides disaster recovery services including data restoration, testing and simulation, communication and reporting as well as post-recovery evaluation, which are designed to help recover and restore DoIT’s mainframe system and data in the event of a disruptive incident such as a natural disaster, hardware failure or other unforeseen event. Disaster recovery services are crucial for ensuring business continuity and minimizing the impact of unforeseen events on IT operations.

The 11:11 Systems agreement contains mutual indemnification and a Limitation of Liability which limits the total aggregate liability of 11:11 Systems, its suppliers, resellers, partners, and their respective affiliates arising from or related to this agreement to the total amounts owed or paid by the County for the relevant products during the twenty-four (24) month period immediately preceding the first occurrence of the events giving rise to such liability.

This purchase is being made via sole source for continuity of service.

CONSEQUENCE OF NEGATIVE ACTION:

If 11:11 Systems’ disaster recovery services are not renewed, DoIT will not have the ability to restore data in the event of a disaster or other unforeseen event.
