RECOMMENDATIONS:
ADOPT Resolution approving the Final Map and Subdivision Agreement for subdivision SD09-09278, for a project being developed by Century Communities of California, LLC, as recommended by the Public Works Director, Discovery Bay area. (District III)

FISCAL IMPACT:
No fiscal impact.

BACKGROUND:
The Public Works Department has reviewed the conditions of approval for subdivision SD09-09278 and has determined that all conditions of approval for Final Map approval have been satisfied.

CONSEQUENCE OF NEGATIVE ACTION:
The Final Map and the Subdivision Agreement will not be approved and recorded.

IN THE MATTER OF approving the Final Map and Subdivision Agreement for subdivision SD09-09278, for a project being developed by Century Communities of California, LLC, as recommended by the Public Works Director, Discovery Bay area. (District III)

WHEREAS, the following documents were presented for Board approval this date:
I. Map
The Final Map of subdivision SD09-09278, property located in the Discovery Bay area, Supervisorial District III, said map having been certified by the proper officials.
II. Subdivision Agreement
A Subdivision Agreement with Century Communities of California, LLC, principal, whereby said principal agrees to complete all improvements as required in said Subdivision Agreement within 2 years from the date of said agreement. Accompanying said Subdivision Agreement is security guaranteeing completion of said improvements as follows:

Performance amount: $52,730

III. Tax Letter
Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 2023-2024 tax lien has been paid in full. The estimate of the 2024-2025 tax lien is $16,050. The amount of Supplementals taxes is estimated to be $123,340. Security guaranteeing payment of said tax lien is as follows:

NOW, THEREFORE, BE IT RESOLVED:
1. That said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County's general and specific plans.
2. That said Final Map is APPROVED and this Board does hereby accept subject to installation and acceptance of improvements on behalf of the public any of the streets, paths, or easements shown thereon as dedicated to public use.
3. That said subdivision agreement is also APPROVED.
