RECOMMENDATIONS:

ADOPT Resolution accepting completion of improvements for road improvement agreement RA23-01256 (cross reference subdivision SD19-0957) for a project developed by Pulte Home Company, LLC, as recommended by the Public Works Director, Discovery Bay area. (District III)

 

FISCAL IMPACT:

No fiscal impact.

 

BACKGROUND:

The developer has completed the traffic signal improvements per the road improvement agreement RA 23-01256, and in accordance with Title 9 of the County Ordinance Code. Said improvements are an off-site requirement of subdivision SD19-09527 and are secured under separate agreement.

 

CONSEQUENCE OF NEGATIVE ACTION:

The completion of improvements will not be accepted.

IN THE MATTER OF: Accepting completion of improvements for road improvement agreement RA23-01256 (cross reference subdivision SD19-0957) for a project developed by Pulte Home Company, LLC, as recommended by the Public Works Director, Discovery Bay area. (District III)

 

WHEREAS, the Public Works Director has notified this Board that the improvements in road improvement agreement RA23-01256 have been completed as provided in the Agreement with Pulte Home Company, LLC, heretofore approved by this Board in conjunction with the filing of the Subdivision Map.

 

WHEREAS, these improvements are located at Bixler Road and Point of Timber Road.

 

NOW, THEREFORE, BE IT RESOLVED that the improvements have been COMPLETED as of  March 5, 2024, thereby establishing the six-month terminal period for the filing of liens in case of action under said Agreement:

BE IT FURTHER RESOLVED the payment (labor and materials) surety for $393,500.00, Bond No. SUR0073401 issued by the above surety be RETAINED for the six month lien guarantee period until September 5, 2024, at which time the Board AUTHORIZES the release of said surety less the amount of any claims on file.

 

BE IT FURTHER RESOLVED that the improvements have been constructed in accordance with the road improvement agreement and are ACCEPTED AS COMPLETE.

 

BE IT FURTHER RESOLVED that the beginning of the warranty period is hereby established, and the $8,000.00 cash deposit (Auditor's Deposit Permit No. 855726, dated September 9, 2022) made by Pulte Home Company, LLC, and the performance/maintenance surety bond rider for $111,000.00, Bond No. SUR0073401 issued by Argonaut Insurance Company RETAINED pursuant to the requirements of Section 94-4.406 of the Ordinance Code until release by this Board.
