Recommendation: Recommendation of the County Administrator

RECOMMENDATIONS:
APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a contract amendment with Frank McGuire effective August 31, 2026, to extend the term through November 30, 2026, with no change to the payment limit, for on-call landscaping services at various County sites and facilities, Countywide.
FISCAL IMPACT:
While this action has no fiscal impact, the contract is funded out of the Facilities Maintenance Budget. (100% General Fund)
BACKGROUND:
The Public Works Department, Facilities Services, is responsible for maintaining the irrigation and drainage systems at County facilities along with weed abatement of County-owned properties. On-call landscaping contracts are on an as-needed basis, utilized when the demand for landscaping and weed abatement services exceeds staffing levels.
Government Code Section 25358 authorizes the County to contract for maintenance and upkeep of County facilities. The Request for Proposal was originally bid on BidSync #2102-457. The Public Works Department conducted a thorough evaluation and Frank McGuire d/b/a The Landscape Company was one of two vendors awarded for this type of work. The Public Works Department originally awarded a three (3) year contract for $2,000,000 with the term September 1, 2021, through August 31, 2024.
Amendment No. 1 was approved and became effective on August 31, 2024, increasing the contract payment limit to $3,000,000 and extending the contract term through August 31, 2026. Amendment No. 2 was approved and became effective on July 1, 2025, to revise the rates in the contract’s service plan.
Facilities Services is requesting approval of Amendment. No. 3 with Frank McGuire d/b/a The Landscape Company, to extend the contract term from August 31, 2026, through November 30, 2026, with no change to the contract payment limit. The requested three-month extension is necessary to allow the Contractor to complete the recently awarded landscaping project at the Public Defender’s Office, located at 800 Ferry Street, Martinez and to ensure continuity of on-call landscaping services during the project completion period.
CONSEQUENCE OF NEGATIVE ACTION:
Without approval of this Contract Amendment No. 3, landscaping services with Frank McGuire d/b/a The Landscape Company will be discontinued, and future projects will not be completed.
