The applicant requests approval of a Variance and Small Lot Design Review to allow a front yard setback of 22 feet (where 25 feet is required), a side yard setback of 11 feet (where 20 feet is required), and an aggregate side yard of less than 40 feet for an existing deck built without permits on a lot of substandard width (per code/enforcement reference BIRF21-00567).
The requested variance and design review are for the purpose of legalizing an existing unpermitted deck structure with a spa, as well as a new side deck structure located within the required front and side yard setbacks.
