RECOMMENDATIONS:
APPROVE and AUTHORIZE the Health Services Director, or designee, to execute on behalf of the County, Contract #76-904-1 with Gold Stallion, Inc., a corporation, in an amount not to exceed $180,000, to provide compounding services for the Contra Costa Regional Medical Center’s (CCRMC) Chemotherapy Infusion Pharmacy, for the period March 1, 2026 through March 1, 2028.
FISCAL IMPACT:
Approval of this Contract will result in annual budgeted expenditures of up to $180,000 and will be funded, as budgeted by the department, 100% by Hospital Enterprise Fund I revenues.
BACKGROUND:
The County has an obligation to provide certain specialized chemotherapy compounding services for the CCRMC Chemotherapy Infusion Pharmacy. This Contractor provides sterile compounded hazardous chemotherapy agents to CCRMC patients in infusion in case of unforeseen closures of the CCRMC Infusion Pharmacy for possible maintenance or emergency reasons. This Contractor has been providing these chemotherapy compounding services for the County since March 2025. Contractor will continue to foster a deep understanding of the CCRMC organizations mission, values, and long-term objectives, under this service Contract.
This Contract is entered into under and subject to the following legal authorities: California Government Code §§ 26227 and 31000; Health and Safety Code § 1451.Health Services Personnel approved this Contract to ensure there is no conflict with labor relations. CCRMC’s Quality Management, Utilization Management and Contract Monitor Staff meet on a regular basis to ensure monitoring and performance measures in the Contract are upheld. This Contractor was approved by the Public Works Department’s Purchasing Division on March 23, 2026.
On March 25, 2025, the Board of Supervisors approved Contract #76-904 with Gold Stallion, Inc. (dba Mariner Advanced Pharmacy), in an amount not to exceed $180,000, to provide chemotherapy compounding services for the CCRMC’s Chemotherapy Infusion Pharmacy, for the period March 1, 2025 through February 28, 2026.
Approval of Contract #76-904-1 will allow the Contractor to continue providing compounding services for the CCRMC’s Chemotherapy Infusion Pharmacy through March 1, 2028. This Contract includes a mutual indemnification provision, which requires each party to indemnify, defend, and hold the other party harmless for claims arising out of the negligence, intentional acts, or omissions of indemnifying party. In the event any litigation arises out of this Agreement, the prevailing party shall be entitled to its reasonable costs of litigation, including reasonable attorney’s fees. This Contract also includes our County standard Health Insurance Portability and Accountability Act (HIPAA) of 1996 Business Associate Addendum. This Contract is retroactive due to a delay in the Sole Source approval process and administrative changes within the Division.
CONSEQUENCE OF NEGATIVE ACTION:
If this Contract is not approved, certain specialized chemotherapy compounding services for CCRMC patients will not be provided and may risk County not being in compliance with The California State Board of Pharmacy.
