Report Title:                     Approve a Right-of-Way contract and Accept TCEs from Rodeo Parker, SC LLC, Rodeo area.

RECOMMENDATIONS:

Acting as the governing body of the Contra Costa County Flood Control and Water Conservation District (District), APPROVE and AUTHORIZE the Chief Engineer, or designee, to execute a right-of-way contract with Rodeo Parker SC, LLC, to acquire approximately 15,923 square feet of Temporary Construction Easements (TCE) within Assessor’s Parcel Nos. 357-132-017 and 357-132-019, with a six-month term commencing July 1, 2025, for payment of $18,400, in connection with the District’s Rodeo Creek Bank Erosion Repair Project (Project No. 7531-6D9N04). (100% Local Flood Control District Funds). (DCD-CP#21-35).

ACCEPT the TCEs on behalf of the District. 

AUTHORIZE the Auditor-Controller to issue a check in the amount of $18,400, payable to Rodeo Parker SC, LLC. a California limited liability company, to be forwarded to the Real Estate Division for delivery.

DIRECT the Real Estate Division of the Public Works Department, on behalf of the District, to deliver the check to Rodeo Parker SC, LLC.

 

FISCAL IMPACT:

100% Local Flood Control District Funds.

 

BACKGROUND:

The Contra Costa County Flood Control and Water Conservation District’s (“District”) Rodeo Creek Bank Erosion Repair Project (“Project”) includes repairing two embankment areas adjacent to, and removing accumulated sediment from within Rodeo Creek, between 4th and 7th Streets in the Rodeo area.  The Project includes removing failed bank material within the eroded areas, reconstructing the embankments, and installing slope protection, among other Project-related work and improvements.  The repairs are needed so that the channel can carry out its intended function of providing flood control safety to the public.  Based on the current Project schedule, construction is expected to begin in July, 2025.

 

In order to construct the Project, as planned, the County requires approximately 15,923 square feet of TCEs within two adjacent parcels of property commonly identified as Assessor’s Parcel Nos. 357-132-017 and 357-132-019.   The easements will have a six-month term, from July 1, 2025, through December 31, 2025.  The TCEs will be used for construction staging and ingress and egress. The TCEs are consistent with the approved plans and specifications for the Project.  Rodeo Parker SC, LLC, the owner of the subject property, has agreed to sell the TCEs to the District for $18,400.  Real Estate Division staff recommends the Board approve this acquisition to ensure the District possesses the property rights it needs for the Project.

On August 1, 2023, the Board of Supervisors, acting as the District’s Board of Directors, approved the Project and determined the Project was exempt from review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15301(d) (CP# 21-35).

 

 

CONSEQUENCE OF NEGATIVE ACTION:

 

The project will not have sufficient land rights to allow construction in accordance with the approved plans and specifications.
