RECOMMENDATIONS:

APPROVE and AUTHORIZE the Health Services Director, or designee, to execute on behalf of the County Contract #76-870 containing mutual indemnification with ICU Medical Sales, Inc., a corporation, in an amount not to exceed $420,250, to provide an infusion pump system, software and services for Contra Costa Health (CCH) patient care for the period from July 1, 2024 through June 30, 2029.

 

FISCAL IMPACT:

This contract will result in contractual service expenditures of up to $420,250 over a 5-year period and will be funded 100% by Hospital Enterprise Fund I.

 

BACKGROUND:

This contract meets the needs of CCH by providing replacing its current infusion pump system. Infusion pumps play a critical role in hospitals by precisely administering fluids, medications, and nutrients to patients, ensuring accurate dosages and timely delivery. Their reliability enhances patient safety and comfort and streamlines medical procedures, allowing healthcare professionals to focus on providing optimal care.  The current infusion pumps are reaching the end of life and are subject to breakdowns. Repairing them is no longer feasible. ICU Medical, Inc.'s Plum Duo, Medfusion, and CADD-Solis infusion pumps are a series of infusion pumps CCH utilizes for its infusion patients' needs and include the functionalities essential for providers and nursing staff. This system ensures precise, accurate dosing for standard infusion needs including more vulnerable patients requiring smaller fluid volumes and those with pain management therapy in acute and outpatient settings.

 

Contra Costa Regional Medical Center’s (CCRMC) Quality Management, Utilization Management and Contract Monitor Staff meet on a regular basis to ensure monitoring and performance measures are upheld. This contactor was approves approved by the Public Works Department’s Purchasing Division on April 16, 2024. This contract was approved by Health Services Personnel to ensure consistence with procedures established by the Labor Relations Division of the County Administrator’s Office. A Summary of service contract deliverables, including measurable outcomes required of the vendor to be monitored by the department in compliance with Section III(B)(7) of the Purchasing Policy include implementation, software, and support services.

 

Under Contract #76-870 the parties will execute a Master Customer Contract for the county’s procurement of an infusion pump system including disposables, infusion pumps, software, and accessories. Per the terms of the contract, County’s payment of fees will allow for software licenses, subscriptions, and corresponding services to automatically renew for succussive annual periods, until terminated.

 

Approval of this new Contract #76-870 allows the contractor to provide services through June 30, 2029. ICU Medical Inc’s total aggregate liability under the agreement is limited to two-million dollars ($2,000,000). Under the Contract the County is obligated to indemnify ICU Medical against third party claims arising from County’s breach of the Contract; County’s violation of any applicable laws; and any death, bodily injury or property damage caused by County in performing the Contract.

 

 

CONSEQUENCE OF NEGATIVE ACTION:

If this contract is not approved, CCRMC will be unable to provide critical intravenous fluid therapy to CCRMC inpatient and outpatient oncology patients.
