Report Title:                     2026 On-Call Habitat Restoration Services Contract, Countywide.

Recommendation of the County Administrator Recommendation of Board Committee

 

RECOMMENDATIONS:

 

(1)                     APPROVE the specifications for the 2026 On-Call Habitat Restoration Services Contract, Countywide area. Project No. 7520-6B8285

 

(2)                     DETERMINE that Triangle Properties, Inc. dba Triangle Land Restoration (“Triangle”), the lowest monetary bidder, submitted the lowest responsive and responsible bid for this project.

 

(3)                     DETERMINE that Ecological Solutions CA. (“Ecological Solutions”), the second lowest monetary bidder, submitted an incomplete and non-responsive bid by failing to complete and sign all pages of the bid form and by failing to possess the required arborist certification, as provided in the project specifications; and REJECT the bid on that basis.

 

(4)                     DETERMINE that Helix Environmental Planning, Inc. (“Helix”), the third lowest monetary bidder, has submitted the second lowest responsive and responsible bid for this project.

 

(5)                     DETERMINE that RECON Environmental, Inc. (“RECON”), the fourth lowest monetary bidder, has submitted the third lowest responsive and responsible bid for this project.

 

(6)                     AWARD on-call contracts to the following three contractors in the following priority for Job Orders, as provided in the project specifications:

 

(A)                     Triangle, in a not to exceed amount ($850,000.00) and the unit prices submitted in the bid ($1,305.00 Total Unit Price).

 

(B)                     Helix, in a not to exceed amount ($850,000.00) and the unit prices submitted in the bid ($1,777.45 Total Unit Price).

 

(C)                     RECON, in a not to exceed amount ($850,000.00) and the unit prices submitted in the bid ($1,808.24 Total Unit Price).

 

(7) DIRECT that the Public Works Director, or designee, shall prepare the contracts.

 

(8) ORDER that, after the contractors have signed the contracts and returned them, together with any required certificates of insurance and other required documents, and the Public Works Director has reviewed and found them to be sufficient, the Public Works Director, or designee, is authorized to sign the contracts for this Board.

 

(9) ORDER that, the Public Works Director, or designee, is authorized to sign any escrow agreements prepared for this project to permit the direct payment of retentions into escrow or the substitution of securities for moneys withheld by the County to ensure performance under the contract, pursuant to Public Contract Code Section 22300.

 

(10) DELEGATE, pursuant to Public Contract Code Section 4114, to the Public Works Director, or designee, the Board’s functions under Public Contract Code Sections 4107 and 4110.

 

(11) DECLARE that, should the award of the contract to Triangle, Helix, or RECON be invalidated for any reason, the Board would not in any event have awarded the invalidated contract(s) to any other bidder, but instead would have exercised its discretion to reject other bids received. Nothing in this Board Order shall prevent the Board from re-awarding the contract to another bidder in cases where the successful bidder establishes a mistake, refuses to sign the contract, or fails to furnish required bonds or insurance (see Public Contract Code Sections 5100-5107).

 

FISCAL IMPACT:

 

The contracts, each for a maximum amount of $850,000, will be funded by 100% Local Road Funds and Flood Control Funds.

 

BACKGROUND:

 

The above project was previously approved by the Board of Supervisors, specifications were filed with the Board, and bids were invited by the Public Works Director. On May 5, 2026, the Public Works Department received bids from the following contractors:

RECON Environmental, Inc., $1,808.24 Total Unit Price

Land Revision, $1,851.00 Total Unit Price

Prunuske Chatham, Inc., $2,988.00 Total Unit Price

Hanford Applied Restoration & Conservation, $5,510.00

The Public Works Director has determined that Ecological Solutions submitted an incomplete and non-responsive bid by failing to complete and sign all pages of the bid form and by failing to possess the required arborist certification, as provided in the project specifications, and the Public Works Director recommends rejection of the bid submitted by Ecological Solutions.

On May 27, 2026, Ecological Solutions was notified in writing of the above determination. A copy of the letter listing the deficiencies is attached to this Staff Report (see Attachment A). On June 1, 2026, Ecological Solutions appealed the above determination. A copy of the appeal letter is attached to this Staff Report (Attachment B). On June 3, 2026, after thoroughly considering the appeal, the Public Works Director determined that the appeal was without merit and denied it. A copy of the denial letter is attached to this Staff Report (Attachment C). The Public Works Director recommends that the Board concur with the denial of the appeal, find that the bid submitted by Ecological Solutions was non-responsive, and reject the bid on that basis.

The Public Works Director has determined and reported as follows:

Triangle submitted the lowest responsive and responsible bid, which is $472.45 (Total Unit Price) less than the next lowest bid.

Helix submitted the second lowest responsive and responsible bid, which is $30.79 (Total Unit Price) less than the next lowest bid.

RECON submitted the third lowest responsive and responsible bid, which is $42.76 (Total Unit Price) less than the next lowest bid.

The Public Works Director has reported that the bids submitted by Triangle, Helix, and RECON comply with the requirements of the project specifications and are the lowest responsive and responsible bids, and recommends that the Board so concur and find and that on-call contracts be awarded to Triangle, Helix, and RECON in that order. As provided in the project specifications, the three on-call contracts would be awarded in the following priority for Job Orders: (1) Triangle; (2) Helix; (3) RECON. The contracts will be for a two-year period with the option of two one-year extensions.

The general prevailing rates of wages, which shall be the minimum rates paid on this project, have been filed with the Clerk of the Board, and copies will be made available to any party upon request.

 

 

 

 

 

 

 

 

 

 

CONSEQUENCE OF NEGATIVE ACTION:

 

The Public Works Department may be unable to complete routine habitat restoration work in a timely manner.
