RECOMMENDATIONS:

APPROVE and AUTHORIZE the Health Services Director, or designee, to execute on behalf of the County, Interagency Agreement #26-658-12 with the County of Santa Clara (for its Santa Clara Valley Medical Center), a political subdivision of the State of California, in an amount not to exceed $50,000, for the provision of outside laboratory testing services for Contra Costa Regional Medical Center (CCRMC), for the period from July 1, 2026 through June 30, 2029.

 

FISCAL IMPACT:

Approval of this contract will result in contractual expenditures of up to $50,000 over a three-year period and will be funded as budgeted by the department for Fiscal Years (FYs) 2026-2029 by 100% Hospital Enterprise Fund I.

 

BACKGROUND:

CCRMC has an obligation to provide health care services, including specialized laboratory testing services that may require special equipment which CCRMC may not have onsite. County contracts with outside laboratories that have the required equipment for these specific testing services. Contractor has been providing outside clinical laboratory testing services for CCRMC since July 1, 2010.

 

This Contract is entered into under and subject to the following legal authorities: California Government Code §§ 26227 and 31000; Health and Safety Code § 1451. Per Administrative Bulletin 600.3, intergovernmental agreements are exempt from solicitation requirements. CCRMC’s Quality Management, Utilization Management and Contract Monitor Staff meet on a regular basis to ensure monitoring and performance measures in the Contract are upheld. This Contract was approved by Health Services Personnel to ensure there is no conflict with labor relations.

 

On July 11, 2023, the Board of Supervisors approved agenda item C.59 to execute Interagency Agreement #26-658-10 with the County of Santa Clara (for its Santa Clara Valley Medical Center), in the amount not to exceed $50,000, to provide neonatal urine toxicology laboratory testing services twenty-four hours a day/seven days a week for at risk newborns at CCRMC, for the period July 1, 2023 through June 30, 2026.

 

Approval of Interagency Agreement #26-658-12 will allow the Contractor to continue providing outside laboratory testing services through June 30, 2029. This agreement contains a mutual indemnification provision that requires the parties to indemnify, defend, and hold harmless the other party for claims arising from the negligent or intentional acts of the indemnifying party.

 

CONSEQUENCE OF NEGATIVE ACTION:

Failure to approve this Interagency Agreement will result in the loss of specialized outside laboratory testing services for CCRMC, including neonatal urine toxicology testing available 24 hours a day, seven days a week and CCRMC will be unable to fulfill its obligation to provide timely, specialized diagnostic testing for at-risk patients, including newborns, potentially compromising patient safety and the quality of care delivered at the facility.
