Report Title: Ratify the issuance of 30-day advance written notice to terminate Contract #23-731 with Accela, Inc.

RECOMMENDATIONS:
RATIFY the February 21, 2024 issuance of a 30-day advance written notice to Accela, Inc., a corporation, requesting termination of Contract #23-731, regarding the provision of its Accela Civic Platform for the Hazardous Materials and Environmental Health Divisions to track inspection and enforcement actions effective at the close of business on March 22, 2024.
FISCAL IMPACT:
This contract was funded by 100% Hospital Enterprise Fund I.
BACKGROUND:
In 2021, Accela, Inc. informed Contra Costa Health (CCH) of its plans to discontinue its EnvisionConnect application in 2024. As a result, CCH conducted a full and open request for proposal process by sending requirements to all leading vendors within the market space. Several vendors responded, submitting questions, and providing demonstrations of their products. After a review of those options, CCH decided to upgrade from EnvisionConnect to Accela's Software as a Service (SaaS) subscription-based products, Accela Civic Platform and Environmental Health Civic Application, to continue to fulfill its need for a data management system to track inspection and enforcement actions in its Hazardous Materials and Environmental Health Divisions.
On October 11, 2022, the Board of Supervisors approved Contract #23-731 with Accela, Inc., in an amount not to exceed $370,800, regarding configuration and onboarding activities to implement Accela's Software as a Service (SaaS) based solution, Accela Civic Platform. This offering was to include Environmental Health Civic Application, Accela Citizen Access Public Portal, Accela Inspector Mobile Application, Geographic Information System (GIS), Accela Construct Application Programming Interface, functionalities regarding mobile and remote inspection, and integrations with third-party systems, payment processing, time accounting, and reporting, for the period from October 11, 2022, through November 1, 2026.
Given the failure of Accela to implement its SaaS platform at Conta Costa County and no specific date for implementation given for the near future, the county is terminating the agreement for non-performance. To ensure compliance with California Assembly Bill 2286 - mandating upgrades to electronic reporting to the State of California, CCH Public Health will renew the software and support services being provided under Contract #23-731 for EnvisionConnect while reigniting the effort of finding a replacement system to track inspection data and enforcement actions carried out by its Health Services Hazardous Materials and Environmental Health Divisions.
Approval by the Board of Supervisors will allow the ratification of the issuance of the 30-day advance written notice to the contractor, in accordance with Section 11.3 (Termination or Suspension for Cause) of the Accela Subscription Services Agreement, that the contract is terminated at the close of business on March 22, 2024.
CONSEQUENCE OF NEGATIVE ACTION:
If this termination is not approved, the contract will not be terminated, and the county will continue to pay for the application which has not been implemented.
