RECOMMENDATIONS:

 

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a contract amendment with Swinerton Builders, effective May 21, 2024, to increase the payment limit by $1,000,000 to a new payment limit of $2,000,000 and to extend the term from December 31, 2025 through December 31, 2026 to provide on-call project management services for various County projects.

 

FISCAL IMPACT:

 

100% various funds as projects are awarded.

 

BACKGROUND:

 

On December 13, 2022, the Board of Supervisors approved an on-call project management services contract with Swinerton, in the amount of $1,000,000. 

 

Since then, nearly all of the available fee under the Agreement has been committed to services associated with the  County’s Central County Storage Facility project. In the meantime, the number of projects with upcoming construction budgets exceeding $1,000,000 handled by Capital Projects Management Division of Public Works has ballooned. Over the course of the past 18 months, the number of such projects has increased from 16 to 26 (with another 9 on our radar).

 

The Central County Storage Facility project is in the early stages of design. As the project moves forward, unexpected developments could result in a need for additional project management services. Therefore, it is advisable to have fee capacity in reserve under the Swinerton on-call Consultant Services Agreement to address such events. Furthermore, the Central County Storage Facility project is expected to be completed no earlier than sometime in 2026, whereas the Swinerton Agreement expires on December 31, 2025.

 

In order to handle the growing workload of larger projects, to maintain contract fee capacity in the reserve for the Central County Storage Facility project, and to keep Swinerton involved on the Central County Storage Facility project through its completion, Amendment No. 1 is necessary to increase the fee limit and extend the contract term of the on-call project management Consultant Services Agreement with Swinerton.

 

 

 

 

 

 

 

 

 

CONSEQUENCE OF NEGATIVE ACTION:

 

If Amendment No. 1 is not approved, Swinerton will not be able to provide project management services for the Central County Storage Facility project through its expected completion and may not be able to provide additional needed services for the project as needs may arise. Furthermore, Public Works will not be able to utilize Swinerton on other large projects to provide services where a high level of construction management expertise is required and where Capital Projects Management staff does not have capacity for the developing workload. Therefore, projects currently in process, both those directly affected and others indirectly affected by a trickle-down impact, would be delayed, which would ultimately result in higher project costs.
