Report Title: Master Contract Amendment #78-072-1 with the County of Alameda
Recommendation: Recommendation of the County Administrator

RECOMMENDATIONS:
APPROVE and AUTHORIZE the Health Services Director, or designee, to execute on behalf of the County Master Contract Amendment #78-072-1 (County of Alameda Procurement #29896; Master Contract #900386) with the County of Alameda, a government agency, to pay Contra Costa County an amount not to exceed $3,065,146 for Contra Costa County’s HIV/STI Program’s provision of HIV support services for low-income residents diagnosed with HIV disease, returning to care and/or transferring to Contra Costa County for the period March 1, 2026 through February 29, 2028.
FISCAL IMPACT:
Approval of this Master Contract Amendment will result in an amount up to $3,065,146 in funding over a two-year period from the County of Alameda, as the Grantee of federal funds under the Ryan White CARE Act/Ryan White HIV/AIDS Program (RWHAP)/Ending the HIV Epidemic (EHE) Initiative. No County match is required.
BACKGROUND:
The Contra Costa County HIV/STI Program receives Ryan White CARE Act/RWHAP/EHE funding from County of Alameda to deliver core medical and support services for County residents living with HIV. These services include medical case management, early intervention services, linkage to care, rapid antiretroviral therapy (ART), medical nutrition therapy, medical transportation, oral health services, and food assistance. EHE supports efforts to improve access to care and health outcomes for individuals newly diagnosed with HIV, returning to care, transferring into Contra Costa County, or not virally suppressed. Program goals include initiating rapid ART for 80% of successfully engaged individuals, enrolling 95% of referred clients into medical case management, and achieving viral suppression within 60 days for 65% of individuals starting ART.
The ongoing Ryan White CARE Act/RWHAP/EHE funding agreement supports approximately 400 clients and allows the County to continue providing essential core and support services, including medical case management, oral health, medical nutrition therapy, medical transportation, and home‑delivered meals/food boxes.
On June 24, 2025 the Board of Supervisors approved Master Contract #78-072 with the County of Alameda, allowing County to receive funding for County’s HIV/STI Program through February 28, 2025, and for successive one-year periods thereafter until terminated. This Contract includes the County agreeing to defend, indemnify, and hold harmless the County of Alameda for claims arising out of the performance of services under the Agreement except where such liabilities are caused by the sole negligence or willful misconduct of the County of Alameda. The terms of the Master Contract #78-072, including the indemnification provision, are incorporated into Master Contract Amendment #78-072-1.
Master Contract Amendment #78-072-1 identifies the Master Contract as Master Contract #900386; however, the correct Master Contract number is Master Contract #78-072 referenced above. The County of Alameda was unable to locate Master Contract #900386, which prompted the parties to execute the updated Master Contract #78-072 that is currently in effect. County of Alameda indicated that the Master Contract number references could not be updated in this Master Contract Amendment #78-072-1 because of the manner in which the contract was set up in their financial system.
Approval of Master Contract Amendment #78-072-1 will allow the County to receive funding in an amount up to $3,065,146 to continue providing support and services for County residents diagnosed with HIV disease, returning to care and/or transferring to Contra Costa County for the period March 1, 2026 through February 29, 2028. This Amendment is late due to County not receiving the amendment documents from County of Alameda until May 13, 2026 and subsequent language negotiations between Contra Costa County and County of Alameda.
CONSEQUENCE OF NEGATIVE ACTION:
If this Master Contract Amendment is not approved, County will not receive funding to provide support and services for County residents diagnosed with HIV disease.
