RECOMMENDATIONS:

ADOPT Resolution accepting completion of public improvements and release of cash deposit for road improvement agreement RA23-01258 (cross-reference DP17-03045) for a project developed by Scannell Properties #304 LLC, as recommended by the Public Works Director, North Richmond area. (District I)

 

FISCAL IMPACT:

100% Developer Fees.

 

BACKGROUND:

The developer has completed the improvements per the Road Improvement Agreement and has met the guarantee performance standards for the warranty period following completion required by Title 9 of the County Ordinance Code

 

CONSEQUENCE OF NEGATIVE ACTION:

The completion of improvements will not be accepted. The developer will not receive a refund of their cash deposit, the performance surety bond will not be exonerated, and the billing account will not be liquidated or closed.

IN THE MATTER OF: Accepting completion of improvements for road improvement agreement RA23-01258 (cross-reference subdivision DP17-03045) for a project developed by Scannell Properties #304 LLC, as recommended by the Public Works Director, North Richmond area. (District I)

 

WHEREAS, the Public Works Director has notified this Board that the improvements in road improvement agreement RA23-01258 (cross-reference DP17-03045) have been completed as provided in the Road Acceptance with Scannell Properties #304 LLC.

 

WHEREAS, these improvements are approximately located at the intersection of Market Avenue and Giaramita Street.

 

NOW, THEREFORE, BE IT RESOLVED that the improvements have been COMPLETED as of July 22, 2025, thereby establishing the six-month terminal period for the filing of liens in case of action under said Road Improvement Agreement:

 

BOND EFFECTIVE DATE: July 7, 2023

 

NAME OF SURETY: The Ohio Casualty Insurance Company

 

BE IT FURTHER RESOLVED the payment (labor and materials) surety for $139,500.00, Bond No. 82C237370 issued by the above surety be RETAINED for the six month lien guarantee period until January 22, 2026, at which time the Board AUTHORIZES the release of said surety less the amount of any claims on file.

 

BE IT FURTHER RESOLVED that the improvements have been constructed in accordance with the road improvement agreement and are ACCEPTED AS COMPLETE.

 

BE IT FURTHER RESOLVED that there is no warranty period required, and the Public Works Director is AUTHORIZED to refund the $2,620.00 cash security for performance (Auditor's Deposit Permit No. DP874113, dated July 27, 2023) plus interest in accordance with Government Code Section 53079, if appropriate, to Scannell Properties #304 LLC, pursuant to the requirements of the Ordinance Code; and the surety bond, Bond No. 82C237370, dated July 14, 2023, are exonerated.
