Report Title:                     APPROVE the contingency fund increase and Contract Change Order No. 7 and   No. 8 for the Storm Damage Repair Project-Alhambra Valley Road at Ferndale, Alhambra Valley Road West of Castro Ranch Road, Bear Creek Road Embankment Repairs Project, Briones, Pinole, and Alhambra Valley areas.

RECOMMENDATIONS:

(1) APPROVE the Storm Damage Repair Project-Alhambra Valley Road at Ferndale, Alhambra Valley Road West of Castro Ranch Road, Bear Creek Road Embankment Repairs Project contingency fund increase of $1,116,465.74 for a new contingency fund total of $1,315,736.75, and a new payment limit of $3,308,446.90, effective July 9, 2024, as recommended by the Public Works Director.

(2) APPROVE and AUTHORIZE the Public Works Director, or designee, to execute Contract Change Order No. 7 and No. 8 with Granite Construction Company effective July 9, 2024, in an amount not to exceed $250,000 and $950,000, respectively, Briones, Pinole, and Alhambra Valley areas. County Project No. 0672-6U6211, County Project No. 0672-6U6225, and County Project No. 0672-6U6226 (District I, V).

 

FISCAL IMPACT:

The Project is being funded by 67% Local Road Funds, 33% Measure J Return to Source (RTS) Funds.

 

BACKGROUND:

Contract Change Order No. 7 is necessary to pay the contractor, Granite Construction Company, for additional costs incurred as a result of extra work to complete the project as intended, related to the repair of storm damage at the Alhambra Valley Road at Ferndale and Alhambra Valley Road West of Castro Ranch Road sites. Contract Change Order No. 8 is necessary to pay the contractor, Granite Construction Company, for additional extended project overhead costs incurred as a result of the extra work included in Contract Change Order No. 7. The contingency fund increase is necessary to compensate the contractor for unforeseen extra work required to complete the project and associated overhead costs.

 

CONSEQUENCE OF NEGATIVE ACTION:

The lack of approval would prevent successful completion of this contract and prevent payment for the additional work performed by the contractor.
