Report Title: Approve and Authorize the acceptance and subsequent conveyance to the Kensington Police Protection and Community Services District of certain offers of dedication for “Ardmore,” “Beloit,” and “Coventry” pathways in Kensington.

RECOMMENDATIONS:
ADOPT the attached Resolution to accept, on behalf of the County, certain offers of dedication for paths located within the Kensington area (District 1) identified as “Ardmore,” “Beloit,” and “Coventry” pathways (“Trails”) in subdivision maps at Book 5 of Maps 103, et seq., and Book 6 of Maps 150, et seq., in the Official Records of the Contra Costa County Clerk-Recorder, pursuant to Government Code section 66477.1.
DETERMINE that the County acquired the Trails for recreational trail purposes and no longer requires the Trails for those purposes, pursuant to Streets and Highways Code section 960.
APPROVE and AUTHORIZE the Public Works Director, or designee, to execute the “Agreement between Contra Costa County and the Kensington Police Protection and Community Services District for the Operation and Maintenance of Recreational Trails in Kensington” (“Agreement”).
DETERMINE that contributing County funds to the Kensington Police Protection and Community Services District (“District”) under the Agreement to defray the District’s maintenance and operation costs is in the County’s interest and necessary to meet the social needs of the County, including health and recreation.
AUTHORIZE the Chair, Board of Supervisors, to execute the quitclaim deed attached as Exhibit B to the Agreement (“Quitclaim Deed”), to quitclaim to the District all of the County’s right, title, and interest in the Trails that the County acquired by the Resolution.
DIRECT the Public Works Director, or designee, to cause the adopted Resolution, this staff report, the executed Quitclaim Deed, and the adopted District resolution and/or certificate of acceptance to be recorded in the Official Records of the Contra Costa County Clerk-Recorder.
DETERMINE that this activity only effectuates a change in ownership of the Trails and, therefore, is not a project under the California Environmental Quality Act.
FISCAL IMPACT:
Under the Agreement, the County will pay the Kensington Police Protection and Community Services District a total of $175,000, from Measure X Parks Funds, over the initial five years to be used for maintaining, repairing, and operating the trails. Payments will be made in $35,000 annual installments approximately around July 1st between 2025 to 2029.
BACKGROUND:
The residents of Kensington requested that existing trails identified as Ardmore, Beloit, and Coventry Paths be accepted by the Kensington Police Protection Community Service District for on-going maintenance and repairs. Since these trails were mapped and dedicated to Contra Costa County on their respective subdivision maps, the County will need to accept the dedications before conveying these trails to the Kensington Police Protection Community Service District.
Following conveyance of the trails to the Districts, the District will be responsible for their future operation and maintenance as public recreational trails. The operation of the trails is in the County’s interest and meets the social needs of the County, including health and recreation. The County will contribute $175,000 over five years to help defray the District’s maintenance costs, from Measure X Parks Funds.
CONSEQUENCE OF NEGATIVE ACTION:
The existing trails will remain without any public agency oversight and maintenance.
