BACKGROUND:
On November 3, 2020, voters in Contra Costa County approved Measure X, a Countywide, 20-year, half-cent sales tax. The ballot measure’s stated intent for Measure X was “to keep Contra Costa’s regional hospital open and staffed; fund community health centers; provide timely fire and emergency response; support crucial safety-net services; invest in early childhood services; protect vulnerable populations; and for other essential county services.”
On February 2, 2021, the Board of Supervisors approved the creation of a 17-member (+10 alternates) Measure X Community Advisory Board (MXCAB). The Board of Supervisors adopted the MXCAB Bylaws on February 2, 2021, with subsequent round of amendments approved on February 9, 2021, April 27, 2021 and May 16, 2023. On July 8, 2025, the Board of Supervisors approved another round of revisions to the MXCAB bylaws: 1) The revisions clarified the MXCAB’s role in the community needs assessment and development of general funding priorities; 2) Updated membership, conflict-of-interest, training, quorum, and meeting requirements; and 3) Reduced alternate seats, eliminated the annual joint BOS meeting, established quarterly meetings, and added a sunset provision.
Today’s item for Board consideration proposes additional revisions to the MXCAB bylaws to update the Board’s membership structure and related administrative provisions. Of the seven At-Large seats, six are currently vacant. Three have been vacant for more than one year, two became vacant after members were removed for lack of attendance for more than one year, and one has been vacant since November 2025. These vacancies have made it increasingly difficult for the MXCAB to achieve quorum. The July 15, 2026 meeting was canceled due to lack of quorum, and staff were unable to identify an alternative date when a sufficient number of members could attend to reschedule the meeting. The remaining At-Large seat is currently filled and would be eliminated when the member’s existing term expires on March 31, 2027.The attached redline and clean versions recommend changes to the bylaws as summarized below:
1. Membership composition and appointments
a. Ultimately eliminate the 7 At-Large member seats, with 6 vacant seats eliminated upon Board approval and the remaining filled seat eliminated when the current member’s term expires on March 31, 2027, reducing the MXCAB from 22 total members to 15
b. Delete provisions related to the recruitment, appointment, terms, and filling of vacancies for At-Large seats
2. Meetings and administration
a. Change the quorum from 9 members to 6 members and require 6 votes to pass a motion, consistent with the revised membership structure
b. Move the annual election of the Chair and Vice Chair from April to the first quarter of the year to align with current member terms
3. Member requirements and administrative updates
a. Update the advisory body trainings requirements to be consistent with County policy and direction from the Clerk of the Board
b. Update appointment and vacancy provisions throughout the bylaws to reflect the revised membership structure
CONSEQUENCE OF NEGATIVE ACTION:
The Measure X Community Advisory Board’s bylaws will remain unchanged, and the MXCAB may continue to experience challenges conducting and rescheduling meetings.
