Report Title: Purchase Order with Daylight Foods, Inc.

RECOMMENDATIONS:
APPROVE and AUTHORIZE the Purchasing Agent, or designee, to execute on behalf of the Health Services Director, a purchase order with Daylight Foods, Inc. in an amount not to exceed $1,700,000 for the purchase of produce, dairy, specialty items, and all other items needed for Contra Costa Health (CCH) for the period of May 1, 2024, through April 30, 2027.
FISCAL IMPACT:
Approval of this action will result in expenditures of up to $1,700,000 over a three-year period and will be funded by Hospital Enterprise Fund I revenues.
BACKGROUND:
The Nutrition Services Department previously used Bay Cities Produce for custom orders and great service. When our contract expired in early 2023, we switched to a vendor under a Vizient contract. However, after just a few weeks, we terminated the service due to delivery and food quality issues. We considered returning to Bay Cities, but they closed and referred us to Daylight Produce.
On December 29, 2023 the request for proposals closed and Daylight Produce, inheriting Bay Cities' staff, was the sole bidder (Bid #2311-716). Their facility impressed us during a site visit, operating seven days a week to provide fresh produce and offering six delivery days. In contrast, the previous vendor outsources precut orders, resulting in decreased product quality due to weekend processing. CCRMC has limited the use of the vendor to stay within PO limits while transitioning all produce and dairy needs to Daylight Foods, Inc.
California Code of Regulations Title 22, § 70273 - Dietetic Service General Requirements mandates the provision of food of the quality and quantity to meet the patient's needs in accordance with physicians' orders and, to the extent medically possible, to meet the Recommended Daily Dietary Allowances, adopted by the Food and Nutrition Board of the National Research Council of the National Academy of Sciences.
CONSEQUENCE OF NEGATIVE ACTION:
If this action is not approved, the Nutrition Services Department will not be able to prepare meals for patients and/or the hospital staff and CCRMC will be in violation of Title 22, CMS, and other regulatory agencies.
