RECOMMENDATIONS:
ADOPT Resolution calling and noticing an election to fill seat numbers Nos. 3 (General), 7 (Safety), and 7 Alternate (Safety) on the Contra Costa County Employees' Retirement Association Board of Trustees (Retirement Board), as recommended by the Retirement Board.

FISCAL IMPACT:
The costs of the election are reimbursed by the Contra Costa County Employees' Retirement Association.

BACKGROUND:
The following seats on the Contra Costa County Employees' Retirement Association Board of Trustees (Retirement Board) are scheduled to become vacant on June 30, 2026, when the current terms of office will expire:



The Internal Operations Committee of the Board of Supervisors conducts recruitment to fill vacancies of Retirement Board seats appointed by the Board of Supervisors. Elections must be conducted to fill the other pending vacancies. It is recommended, therefore, that the Board of Supervisors adopt the attached resolution to set in motion the election procedure to fill seat numbers 3, 7, and 7 Alternate. The recommended procedure is consistent with prior Retirement Board elections and the proposed timetable has been approved by the Assistant County Registrar of Voters.

Government Code Section 31520.1 provides in part: "The second and third members of the board shall be members of the association, other than safety members, elected by those members within 30 days after the retirement system becomes operative in a manner determined by the board of supervisors," and "The seventh member shall be a safety member of the association elected by the safety members. The alternate member shall be that candidate, if any, for the seventh member from the group under Section 31470.2 or 31370.4, which is not represented by a board member who received the highest number of votes of all candidates in that group."

Nominations shall be on forms provided by the County Clerk starting on Monday, March 9, 2026, and filed in that office not later than 5 p.m. on Apri 3, 2026. Election Day is fixed as Tuesday, June 30, 2026. Any Ballot reaching the County Clerk's Office after 5 p.m. on Tuesday, June 30, 2026 shall be voided and not counted.

CONSEQUENCE OF NEGATIVE ACTION:
Disapproval of the recommendation may delay the election, causing a gap in representation in those seats.

IN THE MATTER OF ELECTION OF
RETIREMENT BOARD MEMBERS 3, 7, AND 7 ALTERNATE

The Board of Supervisors of Contra Costa County RESOLVES THAT:

1. The term of office of members 3, 7, and 7 alternate of the Contra Costa County Employees' Retirement Association Board will be completed as of June 30, 2026. The members are as follows:

The appropriate members of the Retirement Association may elect someone to fill these offices for a three-year term beginning July 1, 2026 as provided below.

2. Nominations shall be on forms provided by the County Clerk starting on Monday, March 9, 2026 and filed in that office not later than 5 p.m. on April 3, 2026. The Clerk shall have ballots printed with the nominees' names and with blank spaces for write-in candidates. The Clerk shall have a ballot mailed no later than June 1, 2026 to each member of the appropriate group of the Retirement Association as of April 1, 2026 with a ballot envelope in which to enclose the ballot when voted, imprinted "Retirement Board Ballot" or similar words, together with a postage paid, Business reply envelope addressed to the County Clerk for mailing the ballot envelope to that office, and with instructions that the ballot shall be marked and returned to the County Clerk before 5 p.m. on election day. (See No. 3 below.)

3. Election Day is hereby fixed as Tuesday, June 30, 2026. Any Ballot reaching the County Clerk's Office after 5 p.m. on Tuesday, June 30, 2026 shall be voided and not counted.

4. Notice of election and nomination procedure shall be given by the Clerk by publishing a copy of this resolution at least once in the Contra Costa Times, West Contra Costa Times, East Contra Costa Times, and the San Ramon Valley Times at least ten days before the last day for receiving nominations. (See No 2 above.)

5. On Wednesday, July 1, 2026, the County Clerk shall cause all valid ballots to be publicly opened, counted, and tallied by an Election Board, which shall forthwith certify the return to this Board; and this Board shall declare the winners elected, or arrange for a run-off election in case of a tie.

6. If the County Clerk receives no valid nominations for the position, he shall so inform this Board which shall call a new election therefore; and if the Clerk receives only one nomination for any of these positions, he shall so notify this Board which shall declare that person elected to that position in accordance with Government Code Section 31523(c).
