Report Title: Agreement for Acceptance of Earth Materials with the West County Wastewater District for the Wildcat Creek Fish Passage Implementation Project.

RECOMMENDATIONS:
Acting as the governing body of the Contra Costa County Flood Control and Water Conservation District (Flood Control District), APPROVE and AUTHORIZE the Chief Engineer, or designee, to execute the Agreement for Acceptance of Earth Materials (Agreement) with the West County Wastewater District (WCWD), effective May 1, 2026, for the Wildcat Creek Fish Passage Implementation Project (Project).
FISCAL IMPACT:
There is no direct fiscal impact; however, the Agreement represents significant cost savings to the Project by avoiding long-haul soil transportation and landfill disposal costs. BACKGROUND:
The Flood Control District plans to implement the Project, which includes improving fish passage in Wildcat Creek, widening a sedimentation basin, and modifying a flood control structure to reduce flood risk to nearby neighborhoods. The Project is located in the North Richmond area and will generate soil materials that are suitable for beneficial reuse. WCWD intends to accept the Project soil for use in its planned North Richmond Living Levee Project.
The Agreement permits the Flood Control District and its contractor to transport soil from the Project and stockpile it at the nearby WCWD site. It also outlines the parties’ respective roles and responsibilities, including insurance and indemnity obligations, which will be provided by the Flood Control District’s contractor.
CONSEQUENCE OF NEGATIVE ACTION:
If the Board does not approve the Agreement, the Agreement could not be executed and there would be no WCWD obligation to accept soil from the Project.
