FISCAL IMPACT:

Approval of this Contract Amendment/Extension will result in additional expenditures of up to $453,528 and will remain funded 100% by Hospital Enterprise Fund I revenues (Rate increase)

BACKGROUND:

The CCRMC Clinical Laboratory uses DiaSorin for reagents and supplies for patient specimen testing and is specific to the analyzer used for testing.  Among the tests conducted are those for measles, mumps, rubella, and many others. DiaSorin, Inc. provides all the supplies needed for such testing. These tests are crucial for patients who suffer from various illnesses. The Liaison XL Analyzer is a fully automated chemiluminescence analyzer that performs complete sample processing and runs antigen-antibody assays. This Contract meets the medical needs of County’s population by allowing for the upgrade of County systems, which improves efficiency in the immunoassay laboratories. This amendment was approved by Health Services Personnel consistent with procedures established by the Labor Relations Division of the County Administrator’s Office.

On July 27, 2021, the Board of Supervisors approved Contract #76-753 with DiaSorin Inc., in an amount not to exceed $495,000, for the purchase and services for a Liaison XL Analyzer utilized by the Clinical Laboratory at CCRMC and Contra Costa Health Centers for specimen testing and reagents, for the period from June 1, 2021 through May 31, 2026.

On April 9, 2024, the Board of Supervisors approved Contract Amendment #76-753-1 with DiaSorin Inc., effective March 15, 2024, to increase the payment limit by $21,950 to a new payment limit of $516,950 to add a Liaison XL LAS to the Product Supply Agreement for the Clinical Laboratory at Contra Costa Regional Medical Center and Contra Costa Health Centers with no change in the term.

On June 25, 2024, the Board of Supervisors approved Contract Amendment #76-753-2 with DiaSorin Inc., effective June 25, 2024, to increase the payment limit by $35,271 to a new payment limit of $552,221 for additional reagents for the Clinical Laboratory at Contra Costa Regional Medical Center and Contra Costa Health Centers with no change in the term.

On December 17, 2024, the Board of Supervisors approved Contract Amendment #76-753-3 with DiaSorin, Inc., effective June 25, 2024, to provide additional reagents for the Clinical Laboratory at Contra Costa Regional Medical Center and Contra Costa Health Centers with no change to the payment limit or term.

The Master Supply Agreement obligates the County to (i) indemnify DiaSorin for the modification of Products by The County, (ii) County’s failure to use Product in accordance with the labeling and Instructions for use supplied with the Product, or (iii) County’s negligence or willful misconduct.

Approval of Contract Amendment/Extension #76-753-4 will allow the Contractor to provide additional services, reagents, and consumables through May 31, 2031. The department is requesting retroactive approval of this Contract Amendment/Extension due to internal administrative delays.

CONSEQUENCE OF NEGATIVE ACTION:

If this Contract Amendment/Extension is not approved, then the CCRMC Clinical Laboratory will not be able to perform the specific patient testing that utilizes these supplies, thus impacting patient safety and health.
