RECOMMENDATIONS:

ADOPT Resolution approving the Road Improvement Agreement for development plan permit DP20-03011, for a project being developed by Alves Lane, L.P., as recommended by the Public Works Director, Bay Point area. (District V)

 

FISCAL IMPACT:

No fiscal impact.

 

BACKGROUND:

Improvements have been reviewed and processed by Public Works staff and meets all applicable conditions of approval and County requirements.

 

CONSEQUENCE OF NEGATIVE ACTION:

The Road Improvement Agreement will not be approved.

IN THE MATTER OF: Approving the Road Improvement Agreement for development plan permit DP20-03011, for a project being developed by Alves Lane, L.P., as recommended by the Public Works Director, Bay Point area. (District V)

 

WHEREAS, these improvements are located on Canal Road near 301 Alves Lane in Bay Point (APN 093-100-061). 

 

The following documents were presented for Board approval for Canal Road, development plan permit DP20-03011 a property located in the Bay Point area.

 

A Road Improvement Agreement with Alves Lane, L.P., principal, whereby said principal agrees to complete all improvements, as required in said Road Improvement Agreement, within 2 years from the date of said agreement. Improvements generally consist of road and drainage improvements.

 

Said document was accompanied by security to guarantee the completion of road and drainage improvements, as required by Title 9 of the County Ordinance Code, as follows:

 

I. Cash Bond

Performance Amount: $19,400.00

Auditor’s Deposit Permit Nos. 865895 Date: March 10, 2023, and 868005 Date: April 14, 2023

Submitted by: Alves Lane, L.P.

 

II. Surety Bond

Bond Company: Philadelphia Indemnity Insurance Company

Bond Number and Date: PB02118000043, March 15, 2023

Performance Amount: $1,921,600.00

Labor & Materials Amount: $970,500.00

Principal: Alves Lane, L.P.

 

NOW, THEREFORE, BE IT RESOLVED that said Road Improvement Agreement is APPROVED.
