Report Title:                      Data Use Agreement #76-958 with Kaiser Foundation Health Plan, Inc.

Recommendation: Recommendation of the County Administrator

RECOMMENDATIONS:

APPROVE and AUTHORIZE the Health Services Director, or designee, to execute on behalf of the County  Data Use Agreement (DUA) #76-958 with Kaiser Health Foundation Plan, Inc. a non-profit corporation,  to allow the parties to receive, use, and disclose Medi-Cal member  data for the purpose of coordinating Member care and Medi-Cal coverage for justice involved individuals upon release from incarceration in Contra Costa County, for the period October 1, 2026 through October 1, 2027, and will automatically renew for successive one year periods until terminated pursuant to its terms, subject to final approval by the County Administrator and approval as to form by County Counsel.

FISCAL IMPACT:

This is a non-financial Agreement. There is no cost to the County.

BACKGROUND:

Justice involved individuals are people who are now, or have spent time, in jails, youth correctional facilities, or prisons and are at higher risk for injury and death than the general public. They face disproportionate risk of violence, overdose, and suicide. On January 26, 2023, California became the first state in the nation approved to offer a targeted set of Medicaid services to youth and eligible adults in state prisons, County jails, and youth correctional facilities. Through this Justice Involved Reentry Initiative, Contra Costa County’s Dentition Health Division is taking significant steps to address poor health outcomes in this population by establishing pre-release Medi-Cal enrollment strategies to ensure individuals have continuity of coverage upon their release, and access to key services to help them successfully return to the community. Detention Health plans to go live with the CalAIM Justice Involved Initiative in October 2026. This DUA assists with meeting the Department of Health Care Services (DHCS) and Medi-Cal mandates.

Detention Health provides medical, mental health, and dental services to incarcerated Members housed at the Martinez Detention Facility (MDF), West County Detention Facility (WCDF), Marsh Creek Detention Facility (MCDF), and West County Reentry, Treatment, and Housing Detention Facility (WRTH). These services are provided per the Board of State Community Corrections - Title 15, Division 1, Chapter 1, Subchapter 4, Article 11 - Minimum Standards for Local Detention Facilities - Medical/Mental Health Services. Detention Health seeks to establish a DUA with Kaiser Foundation Health Plan, Inc., for Medi-Cal Managed Care to ensure that qualified incarcerated individuals who are Medi-Cal Members enroll in, or have suspended enrollment in, a Managed Care Plan (MCP), including individuals newly enrolled during their period of incarceration can access and/or receive services in a coordinated manner from MCP and Detention Health.

Approval of DUA #76-958 will govern the Contractor’s and Detention Health’s data sharing activities for the purposes of coordinating Members’ care and Medi-Cal coverage for justice involved individuals upon release from incarceration in Contra Costa County, effective October 1, 2026. This DUA includes mutual indemnification to hold harmless both parties for any claims arising out of the performance of this Contract.

CONSEQUENCE OF NEGATIVE ACTION:

If this DUA is not approved, County and Contractor will not be permitted to access Member data and will be out of compliance with DHCS mandated data sharing requirements.
