RECOMMENDATIONS:

APPROVE and AUTHORIZE the Purchasing Agent, or designee, to execute on behalf of the Health Services Director, an amendment to Purchase Order #28569 with MXR Imaging, Inc. to remove two (2) ultrasound trophons (Serial #s: 110291s70n, 110276s70n) from maintenance service coverage at Contra Costa Regional Medical Center (CCRMC) with no changes to the payment limit of $157,050 or the original term of May 1, 2023 through April 30, 2026.

 

FISCAL IMPACT:

Approval of these actions will result in expenditures of up to $157,050 over a three-year period and will be funded by Hospital Enterprise Fund I revenues.

 

BACKGROUND:

Merry X-Ray Corporation provides diagnostic imaging equipment and repair services for the Diagnostic Imaging Department at CCRMC and Health Centers. CCRMC providers use ultrasound exams and ultrasound probes for several purposes, including during pregnancy, for diagnosing conditions, and image guidance during certain procedures without needing to make an incision. 

 

Merry X-Ray Corporation has been operating in the diagnostic imaging market for over 60 years and is a national service and equipment provider for all levels of healthcare with a full range of imaging equipment and highly trained technicians to service the different modalities. The company also provides CT, MRI, and ultrasound equipment and services with high-quality cost-efficient service solutions nationwide.

 

On July 11, 2023 the Board of Supervisors approved agenda item C.51 to execute a purchase order with MXR Imaging, Inc. in an amount of $157,050 and two related maintenance agreements for service on ultrasound machines at CCRMC including parts and labor for repairs as well as replacement and service for Transesophageal Echocardiograph (TTE) and stipulated Transthoracic Echocardiography probes for the period from May 1, 2023 through April 30, 2026.

 

The original agreement specifies that MXR Imaging, Inc. will have no liability to the County, or any third party for any consequential, incidental, indirect, punitive, or special losses or damages, the agreements are effective upon customer signature and MXR Imaging, Inc. acceptance through the end of the 36-month term.

 

CCRMC is currently contractually obligated to pay GE Healthcare for maintenance services on the two trophons under an agreement that was signed with GE Precision Healthcare in 2020 (#76-696). This amendment will ensure that CCRMC avoids paying for maintenance services under both agreements.

 

CONSEQUENCE OF NEGATIVE ACTION:

If this action is not approved, CCRMC and Health Centers will unnecessarily pay twice the cost for the maintenance of these two pieces of ultrasound equipment.
