Report Title:                     Accepting completion of landscape improvements for Subdivision Agreement (Right-of-Way Landscaping) for subdivision SD80-06013, (Phase II),  Bethel Island area.

RECOMMENDATIONS:

ADOPT Resolution accepting completion of landscape improvements for the Subdivision Agreement (Right-of-Way Landscaping) for subdivision SD80-06013 (Phase II), for a project being developed by SDC Delta Coves, LLC, as recommended by the Public Works Director, Bethel Island area. (District III)

 

FISCAL IMPACT:

100% Developer Fees.

 

BACKGROUND:

The developer has completed the landscape improvements per the Subdivision Agreement (Right-of-Way Landscaping), and in accordance with Title 9 of the County Ordinance Code.

 

CONSEQUENCE OF NEGATIVE ACTION:

The completion of improvements will not be accepted.

IN THE MATTER OF: Accepting completion of landscape improvements for a Subdivision Agreement (Right-of-Way Landscaping) for subdivision SD80-06013 (Phase II), for a project being developed by SDC Delta Coves, LLC, as recommended by the Public Works Director, Bethel Island area. (District III)

 

WHEREAS, these improvements are approximately located near Bethel Island Road and Gateway Road.

 

The Public Works Director has notified this Board that the Right-of-Way Landscaping Improvements for subdivision SD80-06013 (Phase II), have been completed as provided in the Subdivision Agreement (Right-of-Way Landscaping) with SDC Delta Coves, LLC, heretofore approved by this Board.

 

NOW, THEREFORE, BE IT RESOLVED that the landscape improvements have been COMPLETED as of January 20, 2026, thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement (Right-of-Way Landscaping):

 

DATE OF AGREEMENT : January 23, 2018                                          

NAME OF SURETY:                     Lexon Insurance Company

  

BE IT FURTHER RESOLVED the payment (labor and materials) surety for $1,660,400.00, Bond No. 1083541 issued by the above surety be RETAINED for the six month lien guarantee period until July 20, 2026, at which time the Board AUTHORIZES the release of said surety less the amount of any claims on file.

 

BE IT FURTHER RESOLVED that the Right-of-Way Landscaping improvements are ACCEPTED AS COMPLETE. Upon approval by the Board of Supervisors, the HOA, Delta Coves Maintenance Corporation, shall retain the landscape improvements for maintenance.

 

BE IT FURTHER RESOLVED that there is no warranty period required, and the Public Works Director is AUTHORIZED to refund the $33,200.00 cash security for performance (Auditor's Deposit Permit No. DP750965, dated December 7, 2017) plus interest in accordance with Government Code Section 53079, if appropriate, to SDC Delta Coves, LLC, pursuant to the requirements of the Ordinance Code; and the Subdivision Agreement (Right-of-Way Landscaping) and surety bond, Bond No. 1083541, dated October 23, 2017, are EXONERATED.
