Report Title: APPROVE the Conveyance of APN 008-210-024 to the Discovery Bay Community Services District, Discovery Bay area
Recommendation: Recommendation of the County Administrator
RECOMMENDATIONS:
APPROVE and AUTHORIZE the Chair, Board of Supervisors, or designee to execute a Quitclaim Deed conveying approximately 0.23 acres located at Willow Lake Road and Discovery Boulevard (APN 008-210-024) to the Discovery Bay Community Services District find that the land being conveyed to another public agency is classified as exempt surplus land under the surplus land act.
DETERMINE that the activity is not subject to the California Environmental Quality Act (CEQA) pursuant to Article 5, Section 15061(b)(3) of the CEQA Guidelines as it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment.
FISCAL IMPACT:
No fiscal impact.
BACKGROUND:
On August 13, 2003, the Board of Supervisors approved the dissolution of Service Area M-8 (LAFC 03-23). The Contra Costa County Public Works Department Real Estate division (Real Estate) has been requested to Quitclaim the parcel to the Discovery Bay Community Services District (DBCSD).
The project is needed to ensure that property ownership accurately reflects the governance structure following the dissolution of County Service Area M-8. Clear and unencumbered title is necessary to enable DBCSD to proceed with infrastructure improvements that cannot occur until Contra Costa County (County) fully relinquishes its interest in the parcel. Supporting documentation-including subdivision mapping, dissolution records, historical grant deeds, and applicable map notations-has been compiled to verify the County's interest and provide the basis for the quitclaim transaction. Completing this action promptly will allow DBCSD to advance planned improvements consistent with local land use and service objectives. Any future development, improvement, or use of the Property will be subject to review under CEQA by DBCSD.
CONSEQUENCE OF NEGATIVE ACTION:
The property ownership will not accurately reflect the governance structure following the dissolution of County Service Area M-8.
