Report Title: Amendment to Purchase Order with Elsevier Inc.

RECOMMENDATIONS:
APPROVE and AUTHORIZE the Purchasing Agent, or designee, to execute on behalf of the Health Services Director, (1) an amendment to purchase order #31561 with Elsevier Inc. to increase the payment limit by $13,205, to a new amount not to exceed $644,903, (2) Amendment No.1 to the Elsevier Master Agreement, and (3) Amendment No. 2 to Schedule 17 of the Master Agreement for the health professional e‑learning‑management system, with no change to the original term ending December 29, 2027.
FISCAL IMPACT:
This purchase order will result in expenditures of up to $644,903 over a three-year period and will be funded by Hospital Enterprise Fund I revenues.
BACKGROUND:
Elsevier Inc. provides a single, streamlined skill assessment and e-learning package for individual staff orientation and annual competency recertification assessment at Contra Costa Health (CCH). The nurses, therapists, and other health professionals have the resources necessary to reduce risk and improve patient outcomes, through the e-learning system of Elsevier.
On December 15, 2015, the Board of Supervisors approved agenda item C.57 to execute the Elsevier Master Agreement (“Master Agreement”) with an effective date of October 1, 2015, and remains in effect until terminated.
On April 16, 2019, the Board of Supervisors approved agenda item C.51 to execute a purchase order with Elsevier Inc. in the amount of $158,592 to renew its subscription e-learning management system for the period December 30, 2018, through December 29, 2019.
On December 3, 2024, the Board of Supervisors approved agenda item C.94 to execute a purchase order with Elsevier Inc. in the amount of $631,698 to renew its subscription e-learning management system for the period from December 30, 2024, through December 29, 2027.
The Master Agreement includes the terms under which Elsevier will provide services to the County, which are particularly described in schedules issued under the Master Agreement. Since 2019 and continuing to present, the Purchasing Agent has issued annual purchase orders to Elsevier. The purpose of this purchase order is to renew the subscription to the e-learning software for an annual term. Execution of Amendment No.2 to Schedule 17 of the Master Agreement, and issuance of an amendment to purchase order #31561 will allow for a continuation of training for nurses and other hospital staff through December 29, 2027. On April 22, 2026 the Purchasing Agent approved the continued use of Elsevier Inc.
CONSEQUENCE OF NEGATIVE ACTION:
Failure to approve this action will cause annual competency recertification to be put on hold. If individual staff orientation and annual competency recertifications are not completed, staff will be out of compliance with regulatory agencies which affect licensure and CCH policies, procedures, and job requirements.
