Report Title: APPROVE the Conveyance of three grant of easements to Pacific Gas and Electric Company
☒Recommendation of the County Administrator ☐ Recommendation of Board Committee

RECOMMENDATIONS:
Acting as the governing body of the Contra Costa County Flood Control and Water Conservation District, APPROVE and AUTHORIZE the Chair, Board of Supervisors, to execute three grant of easements for the relocation of an approximately 6,418 square foot gas pipeline to PACIFIC GAS AND ELECTRIC COMPANY (PG&E) within the District’s Davilla Road right of way, North Richmond area pursuant to Government Code Section 25526.6 and Section 31 of the Contra Costa County Flood Control and Water Conservation District. (Project No.: WL72RP, DP 18-3007, CP# 23-23)
DETERMINE that the conveyance of said easements is in the public interest and will not substantially conflict or interfere with the District’s use of the property.
DIRECT the Real Estate Division of the Public Works Department to cause said Grant of Easements and a certified copy of this Board Order to be delivered to the grantee for recording in the office of the County Clerk-Recorder.
FISCAL IMPACT:
No fiscal impact.
BACKGROUND:
CenterPoint Properties is building three warehouse buildings on a 31.48 acre site comprised of 19 parcels identified as 506 Brookside Drive (Assessor’s Parcel Number 409-300-037 et al) in the unincorporated North Richmond area of Contra Costa County. The development project was approved by the Planning Commission on May 25, 2022 (DP18-3007 and MS19-0009) and is located at the southeastern corner of Fred Jackson Way and Brookside Drive. The project includes various off-site improvements along Fred Jackson Way and Brookside Drive, including roadway improvements, traffic signals, sidewalks, curbs, bioretention swales, and utility connections.
Pacific Gas & Electric requires a Gas Line Easement to accommodate the relocation of an existing line from CenterPoint’s property to the District’s right of way along Davilla Rd. The relocation of the gas line is needed to continue service to Verde Elementary School and adjacent eastern properties once the CenterPoint Project is completed.
On November 1, 2023, the County determined that the project is not subject to the California Environmental Quality Act (CEQA) pursuant to Categorical Exemption Article 5, Section 15601(b)(3) of the CEQA Statute and Guidelines as it can be seen with certainty that there is no possibility that the activity may have a significant adverse effect on the environment.
CONSEQUENCE OF NEGATIVE ACTION:
If the Easements are not approved, PG&E cannot construct, replace, maintain, inspect, and use equipment for public utility purposes and service to Verde Elementary School and adjacent Easterly properties may lose service.
