RECOMMENDATIONS:
ADOPT Resolution accepting completion of improvements along existing County roads for subdivision SD09-09278, for a project developed by Century Communities of California, LLC, as recommended by the Public Works Director, Discovery Bay area. (District III)
FISCAL IMPACT:
No fiscal impact.
BACKGROUND:
The developer has completed the improvements per the Subdivision Agreement, and in accordance with the Title 9 of the County Ordinance Code.
CONSEQUENCE OF NEGATIVE ACTION:
The completion of improvements will not be accepted.

IN THE MATTER OF: Accepting completion of improvements along existing County roads for subdivision SD09-09278, for a project developed by Century Communities of California, LLC, as recommended by the Public Works Director, Discovery Bay area. (District III)
WHEREAS, the Public Works Director has notified this Board that the improvements in subdivision SD09-09278 have been completed as provided in the Subdivision Agreement with Century Communities of California, LLC, heretofore approved by this Board in conjunction with the filing of the Subdivision Map.
WHEREAS, these improvements are approximately located near Bixler Road and Newport Drive.
NOW, THEREFORE, BE IT RESOLVED that the improvements have been COMPLETED as of June 9, 2026, thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement:

NAME OF SURETY: Euler Hermes North America Insurance Company
BE IT FURTHER RESOLVED the payment (labor and materials) surety for $2,636,500.00, Bond No. US3003993 issued by the above surety be RETAINED for the six month lien guarantee period until December 9, 2026, at which time the Board AUTHORIZES the release of said surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that Bixler Road and Newport Drive for the hereinafter described public improvements, as shown and dedicated for public use on the Final Map of subdivision SD09-09278 filed May 30, 2024, in Book 557 of final maps at Page 1, Official Records of Contra Costa County, State of California, are ACCEPTED AS COMPLETE
BE IT FURTHER RESOLVED that Astilbe Street, Bluebell Circle, and Clover Street for the hereinafter described private roads, as shown and dedicated for private use on the Final Map of Subdivision SD09-09278 filed May 30, 2024, in Book 557 of final maps at Page 1, Official Records of Contra Costa County, State of California, have been COMPLETED and are NOT ACCEPTED.
BE IT FURTHER RESOLVED that the beginning of the warranty period is hereby established, and the $52,730.00 cash deposit (Auditor's Deposit Permit No. 887934, dated March 26, 2024) made by Century Communities of California, LLC, and the performance-maintenance surety bond rider for $790,950.00, Bond No. US3003993 issued by Euler Hermes North America Insurance Company RETAINED pursuant to the requirements of Section 94 4.406 of the Ordinance Code until release by this Board.
