Report Title: Authorization to exercise new powers in County Service Area R-7, Zone A, Alamo area.

RECOMMENDATIONS:
1. RECEIVE a copy of Resolution No. 23-11 of the Contra Costa Local Agency Formation Commission (LAFCO), activating specified latent powers of County Service Area (CSA) R-7 within Zone A.
2. ADOPT Resolution authorizing the exercise of the newly activated powers within Zone A, and DIRECT the Clerk of the Board of Supervisors to mail a copy of the resolution to Contra Costa LAFCO within 30 days.
FISCAL IMPACT:
Costs associated with the exercise of the new powers will be funded with existing ad valorem tax revenues allocated to CSA R-7, Zone A, or revenues from new funding sources approved by the property owners in CSA R-7, Zone A.
BACKGROUND:
On July 18, 2023, at the direction of the Board, an application was submitted to Contra Costa LAFCO for a change in organization of CSA R-7 to activate latent powers under Government Code section 25213, subdivisions (j), (o) and (w), to do the following within Zone A:
1. Maintain street landscaping in the Boulevard of Trees area;
2. Provide funding for the services of the Alamo Municipal Advisory Council (MAC); and
3. Acquire, construct, improve, maintain, and operate community facilities, such as a community center.
On November 8, 2023, Contra Costa LAFCO adopted Resolution No. 23-11, approving the activation of latent powers to provide street landscape maintenance services and funding for services of the Alamo MAC, and to acquire, construct, improve, operate, and maintain community facilities, including but not limited to a community center within the district boundaries. The latent power pertaining to community facilities was conditioned upon adequate financing.
Government Code section 25213.5, subdivision (c), provides that a CSA may exercise a latent power after receiving approval of the local agency formation commission, and requires the clerk of the board of the CSA to mail to the local agency formation commission a copy of a resolution adopted by the board, within 30 days of its adoption. The adoption of Resolution is recommended to comply with this statutory requirement.
CONSEQUENCE OF NEGATIVE ACTION:
Resolution will not be adopted.

IN THE MATTER OF: Authorizing the Exercise of New Powers in County Service Area R-7 within Zone A, Alamo area (District II)
A. On January 28, 1974, the Board of Supervisors adopted Resolution No. 74/105, establishing County Service Area (CSA) R-7 to provide parks and recreation services in the San Ramon Valley area, including Alamo, subject to confirmation by the voters in a special election on the question of establishment of the county service area.
B. On July 9, 1974, the Board adopted Resolution No. 74/597, in which the Board determined that a combined measure on the question of the formation of the CSA, and to authorize a maximum tax rate, was passed, and declared that the establishment of CSA R-7 was finally established.
C. Zone A of CSA R-7 was created in 1984 and encompasses the Alamo area.

NOW, THEREFORE, THE BOARD OF SUPERVISORS RESOLVED THAT:
In addition to the power to provide parks and recreation services as authorized in Resolution No. 74/105, CSA R-7 is authorized to exercise the powers activated by Contra Costa LAFCO Resolution 23-11, effective immediately.
