I.                     PROJECT SUMMARY

 

The applicant requests a three (3) year extension of the period of time for filing a parcel map, to December 14, 2028, for the Orbisonia Village Project, consisting of four parcels and a Land Use Permit - Development Plan Combination Permit for the development of a three-phase mixed-use project including up to 384 units, not to exceed 165 units in phase one, a 20,900 sq. ft. public library, and 10,900 sq. ft. of commercial space, that was approved under Minor Subdivision CDMS21-00005 and Land Use - Development Plan Combination Permit CDLP21-02015.

 

 

II.                     RECOMMENDATION

 

Department of Conservation and Development, Community Development Division (CDD) staff recommends that the County Planning Commission:

 

GRANT the permit extension to extend the period of time for filing a parcel map by three (3) years to December 14, 2028.

 

III.                     BACKGROUND

 

The Orbisonia Village Project included a Tentative Map for a four parcel Minor Subdivision of a seven-acre site and a Land Use Permit - Development Plan Combination Permit for the development of a three-phase mixed-use project including up to 384 units, not to exceed 165 units in phase one, a 20,900 sq. ft. public library, and 10,900 sq. ft. of commercial space. The project site is bound by Bailey Road to the west, State Route 4 to the north, Ambrose Park to the east, and West Leland Road to the south in the Bay Point area of unincorporated Contra Costa County. The project, including Minor Subdivision CDMS21-00005 and Land Use Permit - Development Plan Combination Permit CDLP21-02015 was considered by the County Planning Commission (CPC) on December 14, 2022. After taking public testimony and considering the recommendation of CDD staff, the CPC approved the project on December 14, 2022. This approval included adopting the CEQA exemption, approving the Tentative Map for the Minor Subdivision, and approving the Land Use Permit - Development Plan Combination Permit.

 

IV.                     DISCRETIONARY TIME EXTENSIONS AND SPECIAL EXTENSIONS

 

A.                     Discretionary Time Extension: The Subdivision Map Act allows for local jurisdictions to grant upon request from the applicant, up to a maximum of six (6) additional years of discretionary extensions of the approved tentative map prior to the expiration of the tentative map (Government Code Section 66452.6(e)). County Code Section 94-2.610 allows up to a three (3) year extension by the advisory agency which originally approved the tentative map prior to expiration of the approved tentative map.

 

The Orbisonia Village Project including the Tentative Map for Minor Subdivision CDMS21-00005 and Land Use - Development Plan Combination Permit CDLP21-02015 was approved on December 14, 2022. The approvals are valid for a period of three (3) years from the approval date, to December 14, 2025. To date, no discretionary extensions have been granted. Therefore, pursuant to County Code Section 94-2.610 and Government Code Section 66452.6(e), the Tentative Map is eligible for its first discretionary extension of up to three (3) years. A total of six (6) years of discretionary extensions is possible under the Subdivision Map Act.

 

B.                     Special Statutory Extensions Granted by State Legislature: Based on the approval date of December 14, 2022, the CDMS21-00005 Tentative Map is not eligible for any special statutory extensions granted by the State legislature through the Subdivision Map Act.

 

V.                     CURRENT EXTENSION REQUEST

 

On July 22, 2025, Pacific West Communities requested an extension of the expiration date of the approved CDMS21-00005 Tentative Map for a period of three years beyond the current expiration date of December 14, 2025 to enable the filing of a parcel map for the Orbisonia Village Project. Pursuant to County Code Section 94-2.610, approval of this extension will extend the date for expiration of the Tentative Map to December 14, 2028. According to the provisions of the Subdivision Map Act (Section 66452.6(e)), up to three (3) additional years of discretionary time extensions for the expiration of the tentative map may be requested in the future. This requested time extension also extends the expiration of the CDLPO21-02015 Land Use Permit - Development Plan Combination Permit.

 

VI.                     CONCLUSION

 

Staff recommends that the County Planning Commission approve the permit extension for the Orbisonia Village Project by three (3) years to December 14, 2028.
